  1.1                          A bill for an act 
  1.2             relating to peace officers; providing for a mandatory 
  1.3             term of imprisonment when deadly force is used in an 
  1.4             assault against a peace officer; amending Minnesota 
  1.5             Statutes 1996, section 609.221. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 609.221, is 
  1.8   amended to read: 
  1.9      609.221 [ASSAULT IN THE FIRST DEGREE.] 
  1.10     Subdivision 1.  [GREAT BODILY HARM.] Whoever assaults 
  1.11  another and inflicts great bodily harm may be sentenced to 
  1.12  imprisonment for not more than 20 years or to payment of a fine 
  1.13  of not more than $30,000, or both.  
  1.14     Subd. 2.  [USE OF DEADLY FORCE AGAINST A PEACE OFFICER.] 
  1.15  Whoever assaults a peace officer, licensed under sections 626.84 
  1.16  to 626.863, when that officer is effecting a lawful arrest or 
  1.17  executing any other duty imposed by law and uses or attempts to 
  1.18  use deadly force against the officer shall be sentenced to 
  1.19  imprisonment for not less than ten years nor more than 20 years 
  1.20  and to a payment of a fine of not more than $30,000, 
  1.21  notwithstanding the provisions of sections 242.19, 243.05, 
  1.22  609.11, 609.12, and 609.135.
