  1.1                          A bill for an act 
  1.2             relating to motor fuels; allowing bulk delivery of 
  1.3             nonoxygenated gasoline for certain purchasers; 
  1.4             amending Minnesota Statutes 1998, section 239.791, 
  1.5             subdivision 1, and by adding subdivisions. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 239.791, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MINIMUM OXYGEN CONTENT REQUIRED.] Except 
  1.10  as provided in subdivisions 10 to 12 14, a person responsible 
  1.11  for the product shall comply with the following requirements: 
  1.12     (a) After October 1, 1995, gasoline sold or offered for 
  1.13  sale at any time in a carbon monoxide control area must contain 
  1.14  at least 2.7 percent oxygen by weight. 
  1.15     (b) After October 1, 1997, all gasoline sold or offered for 
  1.16  sale in Minnesota must contain at least 2.7 percent oxygen by 
  1.17  weight. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 239.791, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 13.  [EXEMPTION FOR CERTAIN RIPARIAN LANDOWNERS.] (a) 
  1.21  Except during a carbon monoxide control period in a carbon 
  1.22  monoxide control area, a person responsible for the product may 
  1.23  offer for sale, sell, and deliver directly to a bulk fuel 
  1.24  storage tank gasoline that is not oxygenated in accordance with 
  1.25  subdivision 1 if the conditions in paragraphs (b) to (e) are met.
  2.1      (b) The nonoxygenated gasoline must be unleaded premium 
  2.2   grade as defined in section 239.751, subdivision 4. 
  2.3      (c) The bulk fuel storage tank must be stationary or 
  2.4   permanent. 
  2.5      (d) The bulk fuel storage tank must be under the control of 
  2.6   an owner of littoral or riparian property and located on that 
  2.7   littoral or riparian property. 
  2.8      (e) The nonoxygenated gasoline must be purchased for use in 
  2.9   vehicles that would qualify for an exemption under subdivision 
  2.10  12, paragraph (a). 
  2.11     Sec. 3.  Minnesota Statutes 1998, section 239.791, is 
  2.12  amended by adding a subdivision to read: 
  2.13     Subd. 14.  [EXEMPTION FOR AIRCRAFT OPERATORS.] A person 
  2.14  responsible for the product may offer for sale, sell, and 
  2.15  deliver directly to a bulk fuel storage tank gasoline that is 
  2.16  not oxygenated in accordance with subdivision 1 for use in 
  2.17  aircraft if the nonoxygenated gasoline is unleaded premium grade 
  2.18  as defined in section 239.751, subdivision 4. 
  2.19     Sec. 4.  [EFFECTIVE DATE.] 
  2.20     Sections 1 to 3 are effective the day following final 
  2.21  enactment.
