  1.1                          A bill for an act 
  1.2             relating to water; wastewater treatment; limiting 
  1.3             National Pollution Discharge Elimination System permit 
  1.4             fees; amending Minnesota Statutes 1994, section 
  1.5             115.03, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 115.03, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [PERMIT FEE LIMITATIONS.] (a) Notwithstanding 
  1.10  other law, the total revenue from National Pollution Discharge 
  1.11  Elimination System permits or similar permits for municipal, 
  1.12  industrial, and other point source discharges into any waters of 
  1.13  the state shall not exceed one-half of the total costs not 
  1.14  federally funded of reviewing and acting upon applications for 
  1.15  agency permits, and implementing and enforcing the conditions of 
  1.16  those permits. 
  1.17     (b) For fees payable from July 1, 1995, to June 30, 1996, 
  1.18  the fee for any individual National Pollution Discharge 
  1.19  Elimination System permit or similar permit for municipal, 
  1.20  industrial, and other point source discharge into any waters of 
  1.21  the state in a calendar year may not exceed 110 percent of the 
  1.22  fee paid by the same permittee for the equivalent discharge 
  1.23  permit during the prior 12-month period.  For fees payable on 
  1.24  July 1, 1996, and thereafter, the fee for any individual 
  1.25  National Pollution Discharge Elimination System permit or 
  2.1   similar permit for municipal, industrial, and other point source 
  2.2   discharge into any waters of the state in a calendar year may 
  2.3   not exceed 105 percent of the fee paid by the same permittee for 
  2.4   the equivalent discharge permit during the prior 12-month 
  2.5   period.  Any fines or penalties levied in association with these 
  2.6   permits shall not be included in the current or prior year fee 
  2.7   amount for purposes of calculating the permit fee increase.  For 
  2.8   fees paid from July 1, 1995, to June 30, 1996, for a specific 
  2.9   permit, the fee paid in the prior 12 months for that permit 
  2.10  shall be considered to be the fee that would have been paid 
  2.11  based on the fee rule in effect on July 1, 1994.  This paragraph 
  2.12  does not apply to permits for discharge from a facility where 
  2.13  the facility design or capacity has changed from the prior year. 
  2.14     Sec. 2.  [EFFECTIVE DATE.] 
  2.15     Section 1 is effective July 1, 1995.
