  1.1                          A bill for an act 
  1.2             relating to state finance; providing that SCORE block 
  1.3             grants that are withheld may be carried forward by the 
  1.4             office of environmental assistance; amending Minnesota 
  1.5             Statutes 1996, section 115A.557, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 115A.557, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [ELIGIBILITY TO RECEIVE MONEY.] (a) To be 
  1.10  eligible to receive money distributed by the director under this 
  1.11  section, a county shall within one year of October 4, 1989: 
  1.12     (1) create a separate account in its general fund to credit 
  1.13  the money; and 
  1.14     (2) set up accounting procedures to ensure that money in 
  1.15  the separate account is spent only for the purposes in 
  1.16  subdivision 2. 
  1.17     (b) In each following year, each county shall also: 
  1.18     (1) have in place an approved solid waste management plan 
  1.19  or master plan including a recycling implementation strategy 
  1.20  under section 115A.551, subdivision 7, and a household hazardous 
  1.21  waste management plan under section 115A.96, subdivision 6, by 
  1.22  the dates specified in those provisions; 
  1.23     (2) submit a report by April 1 of each year to the director 
  1.24  detailing how the money was spent and the resulting gains 
  1.25  achieved in solid waste management practices during the previous 
  2.1   calendar year; and 
  2.2      (3) provide evidence to the director that local revenue 
  2.3   equal to 25 percent of the money sought for distribution under 
  2.4   this section will be spent for the purposes in subdivision 2. 
  2.5      (c) The director shall withhold all or part of the funds to 
  2.6   be distributed to a county under this section if the county 
  2.7   fails to comply with this subdivision and subdivision 2.  
  2.8   Notwithstanding section 16A.28, withheld funds do not lapse and 
  2.9   may be carried forward to the next fiscal year or the next 
  2.10  biennium without the approval of the commissioner of finance. 
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     Section 1 is effective on the day following final enactment.
