  1.1                          A bill for an act 
  1.2             relating to fire safety; requiring commissioner of 
  1.3             public safety to adopt rules for fire-retardant 
  1.4             standard for cigarettes; prohibiting sale of 
  1.5             cigarettes not meeting these standards; proposing 
  1.6             coding for new law in Minnesota Statutes, chapter 299F.
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [299F.90] [CIGARETTE FIRE SAFETY.] 
  1.9      Subdivision 1.  [STANDARDS.] (a) The commissioner of public 
  1.10  safety, with the assistance of the state fire marshal, shall 
  1.11  adopt rules containing fire-retardant cigarette standards before 
  1.12  July 1, 2004.  The standards must: 
  1.13     (1) ensure that cigarettes meet a fire-retardant cigarette 
  1.14  performance standard that limits the risk that a cigarette will 
  1.15  ignite upholstered furniture, mattresses, or other household 
  1.16  furnishings; or 
  1.17     (2) ensure that cigarettes, if ignited, will stop burning 
  1.18  within a time period specified by the standard if the cigarettes 
  1.19  are not smoked during that period. 
  1.20     (b) Beginning January 1, 2005, following the adoption of 
  1.21  the rules required in paragraph (a) or one year after the 
  1.22  effective date of similar standards adopted by rule or law in 
  1.23  any other state, whichever is later, all cigarettes sold, 
  1.24  offered for sale, or manufactured in this state must comply with 
  1.25  these rules. 
  1.26     (c) A person engaged in the manufacture of cigarettes shall 
  2.1   submit to the state fire marshal, in writing and before any sale 
  2.2   in this state, certification that the manufacturer's products 
  2.3   meet the standards required under paragraph (a). 
  2.4      Subd. 2.  [CONDITIONAL REPEALER.] If federal fire-retardant 
  2.5   cigarette standards are enacted that preempt this section, this 
  2.6   section is repealed on the day those federal standards take 
  2.7   effect. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
