  1.1                          A bill for an act 
  1.2             relating to examiners of titles; adding Scott and 
  1.3             Wright counties to those with an alternative means of 
  1.4             compensation; amending Minnesota Statutes 2002, 
  1.5             section 508.12, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 508.12, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [EXAMINER AND DEPUTY EXAMINER.] The judges 
  1.10  of the district court shall appoint a competent attorney in each 
  1.11  county within their respective districts to be an examiner of 
  1.12  titles and legal adviser to the registrar in said county, to 
  1.13  which examiner all applications to register title to land are 
  1.14  referred without further order, and may appoint attorneys to 
  1.15  serve as deputy examiners who shall act in the name of the 
  1.16  examiner and under the examiner's supervision and control, and 
  1.17  the deputy's acts shall be the acts of the examiners.  The 
  1.18  examiner of titles and deputy examiners shall hold office 
  1.19  subject to the will and discretion of the district court by whom 
  1.20  appointed.  The examiner's compensation and that of the 
  1.21  examiner's deputies shall be fixed and determined by the court 
  1.22  and paid in the same manner as the compensation of other county 
  1.23  employees is paid except that in all counties having fewer than 
  1.24  75,000 inhabitants, and in Stearns, Dakota, Scott, Wright, and 
  1.25  Olmsted counties the fees and compensation of the examiners for 
  2.1   services as legal adviser to the registrar shall be determined 
  2.2   by the judges of the district court and paid in the same manner 
  2.3   as the compensation of other county employees is paid, but in 
  2.4   every other instance shall be paid by the person applying to 
  2.5   have the person's title registered or for other action or relief 
  2.6   which requires the services, certification or approval of the 
  2.7   examiner.
