A bill for an act
relating to capital investment; authorizing spending
to acquire and better public land and buildings and
public improvements of a capital nature; appropriating
money for capital projects to enable the reuse of the
Willmar Regional Treatment Center and for
methamphetamine treatment; authorizing the issuance of
general obligation bonds; amending Minnesota Statutes
2004, section 246.0136, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

WILLMAR REGIONAL TREATMENT CENTER.

new text begin Willmar regional treatment center master
plan and reuse study implementation.

new text begin The projects funded in
this section must be implemented consistent with the
recommendations in the final Willmar Regional Treatment Center
Master Plan and Reuse Study prepared and approved under Laws
2003, First Special Session chapter 14, article 6, section 64,
subdivision 2, unless expressly provided otherwise.

new text begin Campus redevelopment. new text end

new text begin $7,880,000 is
appropriated from the bond proceeds fund to the commissioner of
administration to redevelop the campus consistent with the
master plan for health care, mental health, chemical dependency,
housing, and other public purposes.

new text begin (a) $1,780,000 is for repair and renovation of campus
support buildings, campus infrastructure including tunnel
repair, and the demolition of buildings numbered 20, 21, and 25
to 40;

new text begin (b) $6,000,000 is for a grant to Kandiyohi County to
design, renovate, construct, repair, furnish, and equip existing
buildings numbered 8 to 11 and 14 for health care and other
public purposes consistent with reuse according to the master
plan; and

new text begin (c) $100,000 is to predesign new facilities to house a
veterans nursing home to be located on the Willmar campus.

Sec. 2. new text begin BOND SALE.
new text end

new text begin To provide the money appropriated by section 1, from the
bond proceeds fund, the commissioner of finance shall sell and
issue bonds of the state in an amount up to $7,880,000 in the
manner, on the terms, and with the effect prescribed by
Minnesota Statutes, sections 16A.631 to 16A.675, and by the
Minnesota Constitution, article XI, sections 4 to 7.

Sec. 3. new text begin CONVEYANCE OF SURPLUS STATE LAND; KANDIYOHI
COUNTY.

new text begin (a) Notwithstanding Minnesota Statutes, sections 16B.281 to
16B.287, or other law, administrative rule, or commissioner's
order to the contrary, the commissioner of administration may
convey to a local unit of government for no consideration all or
part of the real property at the Willmar Regional Treatment
Center for public purposes consistent with the master plan and
reuse study. The conveyance shall be in a form approved by the
attorney general and subject to Minnesota Statutes, section
16A.695.

new text begin (b) The commissioner of administration may require the
local unit of government to reimburse the state for all or part
of any campus redevelopment funded under section 1 and completed
by the state.

new text begin (c) Notwithstanding Minnesota Statutes, section 16C.23, the
commissioner of administration may convey to a local unit of
government for no consideration all or part of the personal
property determined by the commissioner of human services to be
no longer needed for its operations.

new text begin (d) If the local unit of government sells any property
conveyed under this section to a private entity, the sale must
be at a fair market value.

Sec. 4.

Minnesota Statutes 2004, section 246.0136, is
amended by adding a subdivision to read:

new text begin Methamphetamine treatment program may become an
enterprise activity.
new text end

new text begin The methamphetamine treatment program at
the Willmar Regional Treatment Center may be converted to an
enterprise activity, as provided in this section, after July 1,
2007.

Sec. 5. new text begin APPROPRIATIONS.
new text end

new text begin $....... is appropriated from the general fund to the
commissioner of human services for the biennium ending June 30,
2007, to develop and begin operation of methamphetamine
treatment programs.

enactment.
