  1.1                          A bill for an act 
  1.2             relating to the town of Hokah; authorizing the town of 
  1.3             Hokah in Houston county to vacate a road in an 
  1.4             emergency situation. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [HOKAH TOWNSHIP; TOWN ROAD VACATION.] 
  1.7      Notwithstanding Minnesota Statutes, section 164.06 or 
  1.8   164.07, subdivision 1, the town board of Hokah in Houston county 
  1.9   may by resolution vacate a town road without a petition and 
  1.10  without authorization by the electors of the town, where an 
  1.11  emergency vacation is made necessary by reason of extensive 
  1.12  damage to the road from a natural disaster.  Minnesota Statutes, 
  1.13  section 164.07, subdivisions 2 to 12, apply to a vacation under 
  1.14  this section.  If a parcel of land is left without access to a 
  1.15  public road as a result of the vacation the town board shall 
  1.16  upon petition of the owner of that parcel establish a cartway 
  1.17  for that parcel under Minnesota Statutes, section 164.08.  
  1.18  Notwithstanding Minnesota Statutes, section 164.08, the town 
  1.19  board is responsible for the costs of constructing the cartway 
  1.20  and payment of damages, if any, to the owner or owners of the 
  1.21  land over which the cartway lies. 
  1.22     Sec. 2.  [EFFECTIVE DATE.] 
  1.23     Section 1 is effective the day after the town board of the 
  1.24  town of Hokah in Houston County and its chief clerical officer 
  1.25  timely complete their compliance with Minnesota Statutes, 
  2.1   section 645.021, subdivisions 2 and 3.
