  1.1                          A bill for an act
  1.2             relating to motor vehicles; restricting the use of 
  1.3             certain sound-producing devices on motor vehicles; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 169. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [169.694] [SOUND-PRODUCING DEVICES.] 
  1.8      (a) No person may operate or be in actual physical control 
  1.9   of a motor vehicle in or on which is being operated a radio, 
  1.10  tape or disk player, musical instrument, phonograph, or other 
  1.11  sound-producing device in a manner that unreasonably disturbs 
  1.12  the peace, quiet, or repose of a person of ordinary sensibility. 
  1.13     (b) The playing or use of a device described in paragraph 
  1.14  (a) in a manner as to be plainly audible at a distance of 50 
  1.15  feet from the motor vehicle is prima facie evidence of a 
  1.16  violation of paragraph (a). 
  1.17     (c) This section does not apply to: 
  1.18     (1) antitheft devices; 
  1.19     (2) authorized emergency vehicles; or 
  1.20     (3) motor vehicles with sound-producing devices the use of 
  1.21  which has been authorized by a political subdivision.
