  1.1                          A bill for an act 
  1.2             relating to transportation; allocating revenues from 
  1.3             motor vehicle sales tax; proposing amendment to 
  1.4             Minnesota Constitution, article XIV, by adding a 
  1.5             section to require 75 percent of the proceeds from the 
  1.6             sales tax on motor vehicles be deposited in the 
  1.7             highway user tax distribution fund; amending Minnesota 
  1.8             Statutes 2000, section 297B.09, subdivision 1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 297B.09, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [GENERAL FUND SHARE.] Money collected and 
  1.13  received under this chapter must be deposited as provided in 
  1.14  this subdivision.  
  1.15     Thirty-two Seventy-five percent of the money collected and 
  1.16  received must be deposited in the highway user tax distribution 
  1.17  fund, and the remaining 68 percent of the money proceeds must be 
  1.18  deposited in the general fund.  
  1.19     Sec. 2.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.20     An amendment to the Minnesota Constitution, article XIV, is 
  1.21  proposed to the people.  If adopted, the title of article XIV 
  1.22  will be "TRANSPORTATION" and the article will be amended by 
  1.23  adding a section to read: 
  1.24     Sec. 12.  The legislature shall appropriate in each fiscal 
  1.25  year from the general fund to the highway user tax distribution 
  1.26  fund an amount equal to or greater than 75 percent of the net 
  1.27  proceeds from a sales and excise tax imposed by law on the 
  2.1   purchase price of new and used vehicles. 
  2.2      Sec. 3.  [SUBMISSION TO VOTERS.] 
  2.3      The constitutional amendment proposed in section 2 must be 
  2.4   submitted to the people at the 2002 general election.  The 
  2.5   question submitted must be: 
  2.6      "Shall the Minnesota Constitution be amended to require 
  2.7   that the legislature must annually appropriate for highway 
  2.8   purposes an amount equal to at least 75 percent of net proceeds 
  2.9   from the sales tax on new and used motor vehicles? 
  2.10                                     Yes .......
  2.11                                     No ........"
  2.12     Sec. 4.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective for money collected and received 
  2.14  after June 30, 2002.
