A bill for an act
relating to the environment; requiring a drain filter or sedimentation vault
for certain drain tiles; modifying eligibility for agriculture best management
practices loan program; amending Minnesota Statutes 2006, section 17.117,
subdivision 11a; proposing coding for new law in Minnesota Statutes, chapter 17.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 17.117, subdivision 11a, is amended to
read:


Subd. 11a.

Eligible projects.

All projects that remediate or mitigate adverse
environmental impacts are eligible if:

(1) the project is eligible under the allocation agreement and funding sources
designated by the local government unit to finance the project; deleted text begin and

(2) manure management projects remediate or mitigate impacts from facilities with
less than 1,000 animal units as defined in Minnesota Rules, chapter 7020new text begin ; or

under section 17.131

Sec. 2.

new text begin [17.131] AGRICULTURE DRAINAGE FILTERS; SEDIMENTATION
VAULTS IMPAIRED WATERS.

new text begin (a) A landowner with a drain tile that drains directly into an impaired water, as
defined in section 114D.15, subdivision 5, that is impaired for fecal coliform bacteria,
must install an inline filter at the end of the drain tile or a sedimentation vault at the outlet
of the drain tile. For the purposes of this section, a sedimentation vault must be at least 24
inches in diameter and no more that six feet in diameter.

new text begin (b) After the landowner complies with paragraph (a), the landowner shall report
the installation to the county. A county may not require a permit for compliance with
paragraph (a).
