  1.1                          A bill for an act 
  1.2             relating to independent school district Nos. 138, 
  1.3             North Branch, 139, Rush City, and 2144, Chisago Lakes; 
  1.4             authorizing the districts to impose school impact fees.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [INDEPENDENT SCHOOL DISTRICT NOS. 138, NORTH 
  1.7   BRANCH, 139, RUSH CITY, AND 2144, CHISAGO LAKES; IMPOSITION OF 
  1.8   IMPACT FEES.] 
  1.9      Subdivision 1.  [AUTHORIZATION.] In addition to their 
  1.10  powers under Minnesota Statutes, section 123B.02, independent 
  1.11  school district Nos. 138, North Branch, 139, Rush City, and 
  1.12  2144, Chisago Lakes, may each impose impact fees and use the 
  1.13  proceeds of the fees as provided in this section. 
  1.14     Subd. 2.  [IMPOSITION.] Subject to the requirements of 
  1.15  subdivision 3, the school board of any of the school districts 
  1.16  named in subdivision 1 may, by majority vote, impose a school 
  1.17  facility fee of $1,000 on each new residential unit constructed 
  1.18  within the geographic area of the school district.  The fee is 
  1.19  the liability of the builder or developer and is due and payable 
  1.20  to the chief financial officer of the school district within 60 
  1.21  days after the date the construction is substantially completed. 
  1.22     Subd. 3.  [REFERENDUM.] Imposition of the fee under 
  1.23  subdivision 2 will become effective only upon approval by the 
  1.24  voters of the school district at a general or special election 
  1.25  held within one year of the date of final enactment of this act. 
  2.1      Subd. 4.  [USE OF FEES.] The fees must be used only for the 
  2.2   costs of constructing a new school facility, repaying the 
  2.3   principal and interest on bonds issued for the construction of a 
  2.4   school facility, or capital improvements to an existing school 
  2.5   facility in the school district that imposed the fee. 
  2.6      Subd. 5.  [EFFECTIVE DATE; TERMINATION.] This section is 
  2.7   effective for each of independent school district Nos. 138, 
  2.8   North Branch, 139, Rush City, and 2144, Chisago Lakes, upon 
  2.9   approval by the school board and compliance with Minnesota 
  2.10  Statutes, section 645.021, subdivision 3.  The authority to 
  2.11  impose the fees under this section terminates January 1, 2005.
