1.1 A bill for an act 1.2 relating to judiciary; providing a gross misdemeanor 1.3 penalty for fifth degree arson when the conduct 1.4 results in bodily harm to a person; updating the fine 1.5 amount for a misdemeanor penalty; amending Minnesota 1.6 Statutes 2002, section 609.5632. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 2002, section 609.5632, is 1.9 amended to read: 1.10 609.5632 [ARSON IN THE FIFTH DEGREE.] 1.11 Subdivision 1. [CRIME.] Whoever intentionally by means of 1.12 fire or explosives sets fire to or burns or causes to be burned 1.13 any real or personal property of value is guilty of a 1.14 misdemeanor and may be sentenced to imprisonment for not more 1.15 than 90 days or to payment of a fine of not more 1.16 than$700$1,000, or both. 1.17 Subd. 2. [BODILY HARM.] A person who violates subdivision 1.18 1 where the conduct results in bodily harm is guilty of a gross 1.19 misdemeanor and may be sentenced to imprisonment for not more 1.20 than one year or to payment of a fine of not more than $3,000, 1.21 or both. 1.22 [EFFECTIVE DATE.] This section is effective August 1, 2003, 1.23 and applies to crimes committed on or after that date.
