  1.1                          A bill for an act 
  1.2             relating to intoxicating liquor; removing prohibition 
  1.3             against the keeping of dice on licensed premises; 
  1.4             authorizing the keeping and use of dice on licensed 
  1.5             premises under certain circumstances; amending 
  1.6             Minnesota Statutes 1994, section 340A.410, subdivision 
  1.7             5. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 340A.410, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [GAMBLING PROHIBITED.] (a) No retail 
  1.12  establishment licensed to sell alcoholic beverages may keep, 
  1.13  possess, or operate, or permit the keeping, possession, or 
  1.14  operation on the licensed premises of dice or any gambling 
  1.15  device as defined in section 349.30, or permit gambling therein 
  1.16  except as provided in this subdivision.  
  1.17     (b) Gambling equipment may be kept or operated and raffles 
  1.18  conducted on licensed premises and adjoining rooms when the use 
  1.19  of the gambling equipment is authorized by (1) chapter 349, (2) 
  1.20  a tribal ordinance in conformity with the Indian Gaming 
  1.21  Regulatory Act, Public Law Number 100-497, or (3) a tribal-state 
  1.22  compact authorized under section 3.9221. 
  1.23     (c) Lottery tickets may be purchased and sold within the 
  1.24  licensed premises as authorized by the director of the lottery 
  1.25  under chapter 349A.  
  1.26     (d) Dice and dice cups may be kept on the licensed 
  2.1   premises, but only if: 
  2.2      (1) the dice and dice cups are used exclusively by patrons 
  2.3   of the licensed establishment for the purpose of determining 
  2.4   responsibility for payment for alcoholic beverages, food, or 
  2.5   other items lawfully sold on the licensed premises; and 
  2.6      (2) authorized by the governing body of the home rule 
  2.7   charter or statutory city or town board of the town in which the 
  2.8   licensed establishment is located.
