  1.1                          A bill for an act 
  1.2             relating to local government; authorizing home rule 
  1.3             charter and statutory cities to establish a sidewalk 
  1.4             utility; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 415. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [415.18] [SIDEWALK UTILITY.] 
  1.8      A home rule charter or statutory city may establish a 
  1.9   sidewalk utility as provided in section 412.321 including the 
  1.10  voting requirement of section 412.321, subdivision 2, for other 
  1.11  utilities in statutory cities, or as otherwise provided by law 
  1.12  or charter for utilities for home rule charter cities.  Section 
  1.13  412.321 applies to the creation of the sidewalk utility except 
  1.14  that the creation of the sidewalk utility requires approval by 
  1.15  only a majority vote of those voting on the proposition.  The 
  1.16  purpose of the sidewalk utility is to acquire land for, 
  1.17  construct, maintain, and replace public sidewalks and 
  1.18  appurtenances to public sidewalks.  Snow and ice removal are 
  1.19  expressly not included in the purposes of the utility.  Utility 
  1.20  charges may be imposed on any reasonable and equitable basis on 
  1.21  which other utility charges are made including a uniform charge 
  1.22  per account for another utility to be added to the account for 
  1.23  the other utility but separately listed.  Revenues received for 
  1.24  sidewalk utilities must be segregated from other funds as 
  1.25  otherwise provided for utility revenues and may be used only for 
  2.1   sidewalk utility purposes.
