  1.1                          A bill for an act 
  1.2             relating to workers' compensation; providing that 
  1.3             posttraumatic stress syndrome for a peace officer is 
  1.4             an occupational disease; amending Minnesota Statutes 
  1.5             1998, section 176.011, subdivision 16. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 176.011, 
  1.8   subdivision 16, is amended to read: 
  1.9      Subd. 16.  [PERSONAL INJURY.] "Personal injury" means 
  1.10  injury arising out of and in the course of employment and 
  1.11  includes personal injury caused by occupational disease; but 
  1.12  does not cover an employee except while engaged in, on, or about 
  1.13  the premises where the employee's services require the 
  1.14  employee's presence as a part of that service at the time of the 
  1.15  injury and during the hours of that service.  Where the employer 
  1.16  regularly furnished transportation to employees to and from the 
  1.17  place of employment, those employees are subject to this chapter 
  1.18  while being so transported.  In the case of a peace officer, as 
  1.19  defined in section 626.84, subdivision 1, paragraph (c), 
  1.20  personal injury includes a debilitating psychological reaction 
  1.21  to a traumatic event commonly referred to as posttraumatic 
  1.22  stress syndrome, whether or not there is also an accompanying 
  1.23  physical injury or physical cause of the condition.  For the 
  1.24  purpose of this subdivision "traumatic event" means an event 
  1.25  involving the employee lawfully taking the life or causing great 
  2.1   bodily harm of another by force or violence.  For the purpose of 
  2.2   this subdivision, "great bodily harm" has the meaning given it 
  2.3   in section 609.02, subdivision 8.  Personal injury does not 
  2.4   include an injury caused by the act of a third person or fellow 
  2.5   employee intended to injure the employee because of personal 
  2.6   reasons, and not directed against the employee as an employee, 
  2.7   or because of the employment.
