  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the conveyance of 
  1.3             certain tax-forfeited land that borders public water 
  1.4             or natural wetlands in Hennepin county. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 
  1.7   PUBLIC WATER OR NATURAL WETLANDS; HENNEPIN COUNTY.] 
  1.8      Subdivision 1.  [AUTHORIZATION.] Notwithstanding Minnesota 
  1.9   Statutes, sections 92.45, 103F.535, and 282.018, subdivision 1, 
  1.10  and the public sale provisions of Minnesota Statutes, chapter 
  1.11  282, Hennepin county shall convey to the city of Eden Prairie, 
  1.12  for no consideration, the tax-forfeited land bordering public 
  1.13  water or natural wetlands that is described in subdivision 3. 
  1.14     Subd. 2.  [FORM.] (a) The conveyance must be in a form 
  1.15  approved by the attorney general and provide that the property 
  1.16  reverts to the state if: 
  1.17     (1) the city of Eden Prairie stops using the property for 
  1.18  park and open space purposes; or 
  1.19     (2) paragraph (b) or (c) is violated or not completed. 
  1.20     (b) The conveyance is subject to a conservation easement in 
  1.21  favor of and approved by the Minnesota Land Trust. The 
  1.22  conservation easement shall be subject to a trail easement along 
  1.23  the northerly 14 feet of said property for pedestrians and 
  1.24  bicycles only. 
  1.25     (c) The conveyance is subject to a wetland replacement plan 
  2.1   for construction of approximately three acres of wetland, 
  2.2   approved under Minnesota Statutes, section 103G.2242, and 
  2.3   Minnesota Rules, chapter 8420.  In addition to the requirements 
  2.4   of Minnesota Statutes, section 103G.2242, the replacement plan 
  2.5   shall also be approved by an authorized representative of the 
  2.6   property owners of Sunshine Drive, in the plat of Glenshire 
  2.7   Addition, Eden Prairie, Hennepin county, Minnesota.  Approval 
  2.8   shall not be unreasonably withheld. 
  2.9      (d) If the property reverts to the state, any duly recorded 
  2.10  conservation easement conveyed to the Minnesota Land Trust shall 
  2.11  remain in full force and effect. 
  2.12     Subd. 3.  [DESCRIPTION.] The land to be conveyed is located 
  2.13  in Hennepin county, designated as PIN No. 09-116-22-12-0066, and 
  2.14  described as:  
  2.15     Outlot A, Glenshire Addition, embraced within the West Half 
  2.16     of the Northeast Quarter of Section 9, Township 116 North, 
  2.17     Range 22 West, according to the plat on file in the office 
  2.18     of the Hennepin county recorder. 
  2.19     Sec. 2.  [EFFECTIVE DATE.] 
  2.20     Section 1 is effective the day following final enactment.
