1.1 A bill for an act 1.2 relating to crime prevention; making changes related 1.3 to search warrants; amending Minnesota Statutes 2002, 1.4 sections 626.11; 626.13. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2002, section 626.11, is 1.7 amended to read: 1.8 626.11 [ISSUANCE OF WARRANT.] 1.9 (a) If the judge is satisfied of the existence of the 1.10 grounds of the application, or that there is probable cause to 1.11 believe their existence, the judge must issue a signed search 1.12 warrant, naming the judge's judicial office, to a peace 1.13 officerhaving jurisdiction in the area where the place to be1.14searched is located, to an agent of the bureau of criminal1.15apprehension, to an officer of the metropolitan transit police,1.16or to an agent of the division of alcohol and gambling1.17enforcement who is a licensed peace officer as defined in1.18section 626.84, subdivision 1, paragraph (c)inside or outside 1.19 the officer's jurisdiction. The warrant shall direct the 1.20 officeror agentto search the person or place named for the 1.21 property or things specified, and to retain the property or 1.22 things in the officer'sor agent'scustody subject to order of 1.23 the court issuing the warrant. 1.24 (b) Nothing in sections 626.04 to 626.17 is meant to 1.25 supersede another law or statute that limits a peace officer's 2.1 authority to obtain, serve, or execute a search warrant. 2.2 Sec. 2. Minnesota Statutes 2002, section 626.13, is 2.3 amended to read: 2.4 626.13 [SERVICE; PERSONS MAKING.] 2.5 A search warrant may in all cases be served anywhere within 2.6 the issuing judge's jurisdiction by any of the officers 2.7 mentioned in its directions, but by no other person, except in 2.8 aid of the officer on the officer's requiring it, the officer 2.9 being present and acting in its execution.If the warrant is to2.10be served by an agent of the bureau of criminal apprehension, an2.11agent of the division of alcohol and gambling enforcement, a2.12state patrol trooper, a metropolitan transit police officer, or2.13a conservation officer, the agent, state patrol trooper, police2.14officer, or conservation officerAn officer serving and 2.15 executing a warrant shall notify the chief of police of an 2.16 organized full-time police department of the municipality or, if 2.17 there is no such local chief of police, the sheriff or a deputy 2.18 sheriff of the county in which service is to be made prior 2.19 to service and execution. 2.20 Sec. 3. [EFFECTIVE DATE.] 2.21 Sections 1 and 2 are effective August 1, 2003, and apply to 2.22 search warrants issued or served on or after that date.
