A bill for an act
relating to retirement; permitting certain employees
of Blaine, Spring Lake Park, and Mounds View to become
members of the Public Employees Retirement Association
police and fire fund; amending Minnesota Statutes
2004, section 353.64, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 353.64, is
amended by adding a subdivision to read:

new text begin Pension and disability coverage for blaine,
spring lake park, and mounds view firefighters and emergency
responders.

new text begin (a) An employee of Blaine, Spring Lake Park, or
Mounds View who is:
new text end

new text begin (1) assigned primarily to engage in emergency response
activities for firefighting, medical emergencies, and hazardous
materials situations;
new text end

new text begin (2) a member of the Blaine, Spring Lake Park, or Mounds
View independent nonprofit firefighting corporation;
new text end

new text begin (3) in compliance with all rules, regulations, and
requirements of the Blaine, Spring Lake Park, or Mounds View
independent firefighting corporation and maintains a minimum of
60 hours per year of ongoing continuing firefighting education;

new text begin (4) certified by the Minnesota Fire Certification Board as
a firefighter I or higher;
new text end

new text begin (5) certified by the National Registration Board as a first
responder;
new text end

new text begin (6) certified as a hazardous materials specialist by an
accredited institution;
new text end

new text begin (7) employed primarily by Blaine, Spring Lake Park, or
Mounds View as a firefighter or emergency responder on or after
the effective date of this act; and
new text end

new text begin (8) not eligible after the effective date of this act for
coverage under the agreement signed between the state and the
secretary of the federal Department of Health and Human Services
making the provisions of the federal Old Age, Survivors, and
Disability Insurance Act applicable because the person's
position is excluded after that date from application under
section 355.07 and United States Code, title 42, sections
418(d)(5)(A) and 418(d)(8)(D);

new text begin is a member of the public employees police and fire fund under
sections 353.63 to 353.68. Blaine, Spring Lake Park, and Mounds
View shall deduct the employee contribution from the salary of
each individual as required by section 353.65, subdivision 2;
shall make the employer contribution for each position as
required by section 353.65, subdivision 3; shall meet the
employer recording and reporting requirements in section 353.65,
subdivision 4; and shall file a resolution with the board of
trustees specifying the positions designated to primarily be
engaged in emergency response activities for firefighting,
medical emergencies, and hazardous materials situations.

new text begin (b) An employee who meets the requirements of paragraph (a)
and who becomes a member of the public employees police and fire
fund under sections 353.63 to 353.68 is eligible for disability
benefits under the public employees police and fire fund under
section 353.656, subdivision 1, only if the member becomes
disabled and physically unfit to perform duties as a firefighter
as a direct result of an injury, sickness, or other disability
which occurred while the member was:

new text begin (1) engaged in responding to an emergency call for
assistance;

new text begin (2) engaged in firefighting training; or
new text end

new text begin (3) engaged in fire suppression or rescue activities at the
scene of a fire or rescue.

new text begin (c) An employee who meets the requirements of paragraph (a)
but does not meet the requirements of paragraph (b) is eligible
for disability benefits under subdivision 3.
