1.1 A bill for an act 1.2 relating to state government; modifying previous 1.3 appropriations for certain capital improvements; 1.4 amending Laws 1994, chapter 643, sections 3, 1.5 subdivision 2, 10, subdivision 10, as amended, and 15, 1.6 subdivisions 2 and 4; Laws 1996, chapter 463, sections 1.7 3, subdivision 7, 13, subdivisions 2 and 4, and 24, 1.8 subdivision 8. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Laws 1994, chapter 643, section 3, subdivision 1.11 2, is amended to read: 1.12 Subd. 2. Restore and Renovate 1.13 Capitol Building Exterior 5,000,000 1.14 To the commissioner of administration 1.15 to renovate and improve the capitol 1.16 including reroofing, repair of the roof 1.17 balustrade,andQuadriga restoration, 1.18 and for an exterior stone testing 1.19 program. No more than $35,000 of this 1.20 appropriation is to the capitol area 1.21 architectural and planning board for 1.22 design review fees. 1.23 Sec. 2. Laws 1994, chapter 643, section 10, subdivision 1.24 10, as amended by Laws 1995, First Special Session chapter 2, 1.25 article 1, section 42, is amended to read: 1.26 Subd. 10.Rochester Technical CollegeUniversity 1.27 Center Rochester 1,200,000 1.28 This appropriation istofor predesign 1.29 and design of an integrated campusin1.30accordance with this subdivision.1.31$600,000 of this appropriation is1.32available immediately. The remainder1.33is available after a master academic1.34plan has been approved under clause (3)1.35and the technical college has been1.36sold., remodeling of student support 2.1 facilities, remodeling of facilities 2.2 for joint academic programming, and 2.3 construction of roads and other 2.4 infrastructure to integrate the campus 2.5 for the delivery of consolidated 2.6 college, state university, and 2.7 University of Minnesota programs at the 2.8 University Center Rochester. Planning 2.9 may include consideration of 2.10 codevelopment of facilities with local 2.11 units of government. 2.12(1) The board of trustees of the2.13Minnesota state colleges and2.14universities may enter into an2.15agreement for the sale of the Rochester2.16Technical College. The sale is2.17contingent on the approval of the board2.18of trustees and a determination by the2.19board of trustees that the sale is2.20consistent with its priorities. The2.21sale price shall equal the appraised2.22value if sold to independent school2.23district No. 535, Rochester, or, if2.24sold to any other party, the sale price2.25shall not be less than the appraised2.26value.2.27It is the intent of the legislature2.28that no technical college program2.29reduction, apart from normal program2.30review, shall occur as a result of this2.31sale.2.32(2) The sale shall not cause the2.33technical college to lease space or to2.34move to any temporary site.2.35(3) Prior to the preparation of design2.36documents, the post-secondary boards2.37and the relevant campus staff shall2.38jointly prepare a master academic plan2.39for an integrated campus for the2.40Rochester center facility. The boards2.41shall consider the creation of a2.42polytechnic university. The plan shall2.43be submitted for review to the higher2.44education finance divisions by January2.4516, 1996, and must be approved by the2.46legislature before the remaining2.47$600,000 of the appropriation is2.48available. 2.49(4) The proceeds from the sale of the2.50technical college are appropriated for2.51the design and construction necessary2.52to integrate technical college programs2.53into the Rochester center and to add or2.54modify space where necessary. The new2.55technical college program space must be2.56attached to and must maximize the2.57current services, space, and programs2.58of the technical college, community2.59college, state university, and2.60University of Minnesota cooperative2.61campus. The state board of trustees2.62may not begin construction of this2.63project until the legislature has2.64approved the construction plans.2.65(5) The state board of trustees shall3.1develop a plan to relocate to the3.2Austin, Faribault, and other3.3Southeastern Minnesota campuses all3.4Rochester campus programs that are not3.5essential to the integrated mission3.6planned for the Rochester center3.7facility. This plan must be completed3.8prior to preparing design documents for3.9the technical college addition to the3.10Rochester center.3.11(6) The state board of trustees shall3.12consider relocating the horticulture3.13technology program from the Rochester3.14campus to the Austin campus of3.15Riverland technical college before the3.16start of the 1995-1996 academic year.3.17 Sec. 3. Laws 1994, chapter 643, section 15, subdivision 2, 3.18 is amended to read: 3.19 Subd. 2. Bloomington Ferry Bridge7,631,0005,131,000 3.20 This appropriation is from the state 3.21 transportation fund as provided in 3.22 Minnesota Statutes, section 174.50, to 3.23 match federal funds to complete 3.24 construction of the Bloomington ferry 3.25 bridge and approaches. 3.26 This appropriation is added to the 3.27 appropriation in Laws 1993, chapter 3.28 373, section 14, subdivision 2. 3.29 Sec. 4. Laws 1994, chapter 643, section 15, subdivision 4, 3.30 is amended to read: 3.31 Subd. 4. Local Bridge 3.32 Replacement and Rehabilitation12,445,00014,945,000 3.33 This appropriation is from the state 3.34 transportation fund as provided in 3.35 Minnesota Statutes, section 174.50, to 3.36 match federal funds and to replace or 3.37 rehabilitate local deficient bridges. 3.38 Political subdivisions may use grants 3.39 made under this section to construct or 3.40 reconstruct bridges, including: 3.41 (1) matching federal-aid grants to 3.42 construct or reconstruct key bridges; 3.43 (2) paying the costs to abandon an 3.44 existing bridge that is deficient and 3.45 in need of replacement, but where no 3.46 replacement will be made; 3.47 (3) paying the costs to construct a 3.48 road or street to facilitate the 3.49 abandonment of an existing bridge 3.50 determined by the commissioner to be 3.51 deficient, if the commissioner 3.52 determines that construction of the 3.53 road or street is more cost-efficient 3.54 than the replacement of the existing 3.55 bridge; and 3.56 (4) paying the costs of preliminary 4.1 engineering and environmental studies 4.2 authorized under Minnesota Statutes, 4.3 section 174.50, subdivision 6a. 4.4 Sec. 5. Laws 1996, chapter 463, section 3, subdivision 7, 4.5 is amended to read: 4.6 Subd. 7. Twin Cities 4.7 (a) Architecture Renovation 9,000,000 4.8 Design,renovateconstruct, furnish, 4.9 and equip an addition to the 4.10 architecture building and partially 4.11 renovate the existing building. 4.12 (b) Haecker Hall Renovation 12,000,000 4.13 Design, renovate, furnish, and equip 4.14 Haecker Hall and related space. 4.15 (c) Magnetic Resonance Research 4.16 Building 3,500,000 4.17 Design, construct, furnish, and equip a 4.18 new magnetic resonance research 4.19 building. 4.20 (d) Minnesota Library Access 4.21 Center 38,500,000 4.22 Construct, furnish, and equip the 4.23 Minnesota library access center to 4.24 house the university's archives and 4.25 special collections, immigration 4.26 history research center documents and 4.27 collections, to store less frequently 4.28 used library materials for state 4.29 university, private college, city, 4.30 county, and regional libraries in the 4.31 state, and to house Minitex services. 4.32 (e) Molecular and Cellular 4.33 Therapeutics Facility Remodeling 3,000,000 4.34 Remodel and equip the molecular and 4.35 cellular therapeutics facility, 4.36 including the modification of 4.37 utilities, air filtration, and 4.38 distribution systems, to accommodate 4.39 new research programs. 4.40 Sec. 6. Laws 1996, chapter 463, section 13, subdivision 2, 4.41 is amended to read: 4.42 Subd. 2. Capital Asset 4.43 Preservation and Replacement (CAPRA) 12,000,000 4.44 To be spent in accordance with 4.45 Minnesota Statutes, section 16A.632. 4.46 Up to $900,000 of the money 4.47 appropriated in this subdivision may be 4.48 used as necessary to renovate the 4.49 Governor's Residence in St. Paul for 4.50 life safety, code, security, and 4.51 ancillary storage facility improvements. 4.52 Up to $600,000 of the money 5.1 appropriated in this subdivision may be 5.2 used to continue the electrical utility 5.3 infrastructure conversion of the 5.4 primary feeder loop system to a primary 5.5 selective system by rerouting the 5.6 system around the capitol. 5.7 In accordance with Minnesota Statutes, 5.8 section 16B.31, subdivision 6, the 5.9 commissioner of administration shall 5.10 identify the condition and suitability 5.11 of all major state buildings and office 5.12 space and report the commissioner's 5.13 findings by June 30, 1997, to the 5.14 chairs of the senate committee on 5.15 finance and the house of 5.16 representatives committees on ways and 5.17 means and on capital investment. The 5.18 report must identify the useful life, 5.19 the current condition, the estimated 5.20 cost of currently needed repairs, and 5.21 the suitability for the current state 5.22 purposes of all major state-owned 5.23 buildings and office space owned or 5.24 leased by the state. The legislature 5.25 intends to use the report in 5.26 considering future appropriations to 5.27 the commissioner of administration and 5.28 to state agencies for asset 5.29 preservation. 5.30 Sec. 7. Laws 1996, chapter 463, section 13, subdivision 4, 5.31 is amended to read: 5.32 Subd. 4. Renovate Capitol 5.33 Building 7,400,000 5.34$4,800,000$3,765,000 is to predesign, 5.35 design, and reconstruct the 5.36 northeast terrace and predesign and 5.37 design the northwestterracesterrace 5.38 of the capitol building. 5.39 $1,400,000 is to renovate the lantern 5.40 and related structures on the capitol 5.41 dome. 5.42$1,200,000$2,235,000 is to predesign, 5.43 design, construct, furnish, and equip 5.44 the renovation of the capitol cafeteria 5.45 and related spaces. 5.46 The balance of the appropriation in 5.47 this subdivision that is not needed for 5.48 the projects specified may be used for 5.49 other structural stabilization projects 5.50 at the capitol or to improve the 5.51 capitol mall. 5.52 Sec. 8. Laws 1996, chapter 463, section 24, subdivision 8, 5.53 is amended to read: 5.54 Subd. 8. Lyn/Lake/Jungle5.55TheatrePerforming Arts Center 335,000 5.56 For a grant to Hennepin county to 5.57 design, construct, furnish, and equip 5.58 the Lyn/Lake/Jungle Theatrecommunity 5.59 performing arts center to provide a 6.1 community theater and rehearsal space, 6.2 offices, classrooms and meeting rooms 6.3 for performing arts organizations, arts 6.4 education and arts development and 6.5 outreach in a formerly tax-forfeited 6.6 structure in Hennepin county. Hennepin 6.7 county may contract with a non-profit 6.8 organization for operation of the 6.9 center, subject to Minnesota Statutes, 6.10 section 16A.695. This appropriation is 6.11 not available until the commissioner 6.12 has determined that at least $1,630,000 6.13 has been committed by nonstate sources 6.14 to complete theLyn/Lake/Jungle Theatre 6.15 main stage in a nearby building owned 6.16 and operated by the Jungle Theater and 6.17 that $100,000 has been committed by 6.18 non-state sources to complete the 6.19 community performing arts center. This 6.20 is the final state appropriation for 6.21 this project. 6.22 Sec. 9. [EFFECTIVE DATE.] 6.23 This act is effective the day following final enactment.
