  1.1                          A bill for an act 
  1.2             relating to partition fences; limiting the application 
  1.3             of certain procedures; amending Minnesota Statutes 
  1.4             2000, section 344.03, subdivision 1; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 344. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [344.012] [APPLICABILITY.] 
  1.8      The procedures in this chapter apply to situations in which 
  1.9   both parties to a division line want to erect a fence along that 
  1.10  line.  If only one party wants a fence, that party may erect the 
  1.11  fence and must bear the entire cost of the fence. 
  1.12     Sec. 2.  Minnesota Statutes 2000, section 344.03, 
  1.13  subdivision 1, is amended to read: 
  1.14     Subdivision 1.  [ADJOINING OWNERS.] If all or a part of 
  1.15  adjoining Minnesota land is improved and used, and one or both 
  1.16  of the owners of the land desires desire the land to be partly 
  1.17  or totally fenced, the land owners or occupants shall build and 
  1.18  maintain a partition fence between their lands in equal shares.  
  1.19  The requirement in this section and the procedures in this 
  1.20  chapter apply to the department of natural resources when it 
  1.21  owns land adjoining privately owned land subject to this section 
  1.22  and chapter and the landowner desires the land permanently 
  1.23  fenced for the purpose of restraining livestock.
