  1.1                          A bill for an act 
  1.2             relating to transportation; requiring metropolitan 
  1.3             airports commission to set certain taxicab vehicle 
  1.4             qualifications; allowing quarterly payment of taxicab 
  1.5             permit fee; authorizing certain transfers of taxicab 
  1.6             permits; amending Minnesota Statutes 2002, section 
  1.7             221.091, subdivision 3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 221.091, 
  1.10  subdivision 3, is amended to read: 
  1.11     Subd. 3.  [AUTHORITY OF METROPOLITAN AIRPORTS COMMISSION.] 
  1.12  Notwithstanding any other law: 
  1.13     (a) The metropolitan airports commission may regulate 
  1.14  ground transportation to and from an airport under its 
  1.15  jurisdiction, subject to the provisions of paragraph (b).  The 
  1.16  authority under this paragraph includes, but is not limited to, 
  1.17  regulating the number and types of transportation services, 
  1.18  making concession agreements, and establishing vehicle standards.
  1.19     (b) The metropolitan airports commission may regulate small 
  1.20  passenger vehicles, including taxicabs, serving an airport under 
  1.21  its jurisdiction only by ordinance.  An ordinance adopted under 
  1.22  this paragraph must at a minimum define taxicabs and provide for 
  1.23  driver qualifications, insurance, and vehicle safety, and may 
  1.24  provide for issuance of permits to taxicabs and other small 
  1.25  passenger vehicles and limits on the number of permits issued.  
  1.26  An ordinance under this paragraph may not provide for making 
  2.1   concession agreements relating to small passenger vehicle 
  2.2   service, including taxicabs. 
  2.3      (c) The metropolitan airports commission must not limit the 
  2.4   age of a vehicle that is permitted to be operated as a taxicab 
  2.5   at the Minneapolis-St. Paul International Airport to less than 
  2.6   six years if the vehicle is subject to an annual safety 
  2.7   inspection as provided by ordinance. 
  2.8      (d) Notwithstanding an ordinance to the contrary, the 
  2.9   metropolitan airports commission must allow a taxicab owner to 
  2.10  pay in quarterly installments the annual taxicab permit fee for 
  2.11  use of permitted taxi lanes at the Minneapolis-St. Paul 
  2.12  International Airport. 
  2.13     (e) Notwithstanding an ordinance to the contrary, if a 
  2.14  taxicab permit holder dies, the deceased permit holder's 
  2.15  personal representative may transfer the permit to a member of 
  2.16  the permit holder's immediate family.  For the purpose of this 
  2.17  paragraph, "immediate family" means the spouse, adult child, 
  2.18  brother, or sister of the permit holder, but not a person under 
  2.19  legal disability.  Within five days of the transfer of the 
  2.20  permit, and before the transferee may operate a taxicab at the 
  2.21  Minneapolis-St. Paul International Airport, the transferee must 
  2.22  comply with all metropolitan airports commission ordinance 
  2.23  requirements to which the original permit holder was subject. 
  2.24     Sec. 2.  [PERMIT FEE.] 
  2.25     The metropolitan airports commission may not increase the 
  2.26  annual taxicab permit fee as a result of section 1. 
  2.27     Sec. 3.  [EFFECTIVE DATE.] 
  2.28     Sections 1 and 2 are effective the day after final 
  2.29  enactment.
