  1.1                          A bill for an act 
  1.2             relating to transportation; making seat belt violation 
  1.3             a primary offense; distributing fines to commissioner 
  1.4             of public safety for education relating to seat belts; 
  1.5             amending Minnesota Statutes 1996, section 169.686, 
  1.6             subdivisions 1 and 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 169.686, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [SEAT BELT REQUIREMENT.] A properly 
  1.11  adjusted and fastened seat belt, including both the shoulder and 
  1.12  lap belt when the vehicle is so equipped, shall be worn by: 
  1.13     (1) the driver of a passenger vehicle or commercial motor 
  1.14  vehicle; 
  1.15     (2) a passenger riding in the front seat of a passenger 
  1.16  vehicle or commercial motor vehicle; and 
  1.17     (3) a passenger riding in any seat of a passenger vehicle 
  1.18  who is older than three but younger than 11 years of age. 
  1.19     A person who is 15 years of age or older and who violates 
  1.20  clause (1) or (2) is subject to a fine of $25.  The driver of 
  1.21  the passenger vehicle or commercial motor vehicle in which the 
  1.22  violation occurred is subject to a $25 fine for a violation of 
  1.23  clause (2) or (3) by a child of the driver under the age of 15 
  1.24  or any child under the age of 11.  A peace officer may not issue 
  1.25  a citation for a violation of this section unless the officer 
  1.26  lawfully stopped or detained the driver of the motor vehicle for 
  2.1   a moving violation other than a violation involving motor 
  2.2   vehicle equipment.  The department of public safety shall not 
  2.3   record a violation of this subdivision on a person's driving 
  2.4   record. 
  2.5      Sec. 2.  Minnesota Statutes 1996, section 169.686, 
  2.6   subdivision 3, is amended to read: 
  2.7      Subd. 3.  [APPROPRIATION; SPECIAL ACCOUNT.] The fines 
  2.8   collected for a violation of subdivision 1 must be deposited in 
  2.9   the state treasury and credited to a special account to be known 
  2.10  as the emergency medical services relief account.  Ninety 
  2.11  percent of the money in the account shall be distributed to the 
  2.12  eight regional emergency medical services systems designated by 
  2.13  the emergency medical services regulatory board under section 
  2.14  144.8093, for personnel education and training, equipment and 
  2.15  vehicle purchases, and operational expenses of emergency life 
  2.16  support transportation services.  The board of directors of each 
  2.17  emergency medical services region shall establish criteria for 
  2.18  funding.  Ten percent of the money in the account shall be 
  2.19  distributed to the commissioner of public safety for the 
  2.20  expenses of traffic safety educational programs conducted by 
  2.21  state patrol troopers.  Any fines collected for violations of 
  2.22  subdivision 1, in excess of the amount collected in fiscal year 
  2.23  1997 for violations of subdivision 1, shall be distributed to 
  2.24  the commissioner of public safety for the expenses of 
  2.25  educational programs related to seat belt use. 
  2.26     Sec. 3.  [EFFECTIVE DATE.] 
  2.27     Section 1 is effective August 1, 1997, and applies to 
  2.28  violations committed on and after that date.  Section 2 is 
  2.29  effective July 1, 1997.
