  1.1                          A bill for an act
  1.2             relating to the legislature; eliminating per diem 
  1.3             compensation of members of the legislature; requiring 
  1.4             recommendations on the salaries of members; amending 
  1.5             Minnesota Statutes 1994, sections 3.099, subdivision 
  1.6             1; 3.101; and 3A.01, subdivision 6a. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 3.099, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [PAY DAYS; MILEAGE; PER DIEM.] The 
  1.11  compensation of each member of the legislature is due on the 
  1.12  first day of the regular legislative session of the term and 
  1.13  payable in equal parts on January 15, in the first month of each 
  1.14  term and on the first day of each following month during the 
  1.15  term for which the member was elected.  The compensation of each 
  1.16  member of the legislature elected at a special election is due 
  1.17  on the day the member takes the oath of office and payable 
  1.18  within ten days of taking the oath for the remaining part of the 
  1.19  month in which the oath was taken, and then in equal parts on 
  1.20  the first day of each following month during the term for which 
  1.21  the member was elected. 
  1.22     Each member shall receive mileage for necessary travel to 
  1.23  the place of meeting and returning to the member's residence in 
  1.24  the amount and for trips as authorized by the senate for senate 
  1.25  members and by the house of representatives for house members. 
  1.26     Each member shall also receive per diem living expenses 
  2.1   during a regular or special session of the legislature in the 
  2.2   amounts and for the purposes as determined by the senate for 
  2.3   senate members and by the house of representatives for house 
  2.4   members. 
  2.5      On January 15 in the first month of each term and on the 
  2.6   first day of each following month, the secretary of the senate 
  2.7   and the chief clerk of the house of representatives shall 
  2.8   certify to the commissioner of finance, in duplicate, the amount 
  2.9   of compensation then payable to each member of their respective 
  2.10  houses and its total. 
  2.11     Sec. 2.  Minnesota Statutes 1994, section 3.101, is amended 
  2.12  to read: 
  2.13     3.101 [LIVING EXPENSES.] 
  2.14     A member of the legislature in addition to the compensation 
  2.15  and mileage otherwise provided by law shall be reimbursed for 
  2.16  travel, mileage, living and other expenses incurred in the 
  2.17  performance of duties or engaging while engaged in official 
  2.18  business during a regular or special session and when the 
  2.19  legislature is not in session.  Reimbursement may be provided 
  2.20  only for documented expenses, in the manner and amount 
  2.21  prescribed by the senate committee on rules and administration 
  2.22  for senators and by the house committee on rules and legislative 
  2.23  administration for house members.  
  2.24     Sec. 3.  Minnesota Statutes 1994, section 3A.01, 
  2.25  subdivision 6a, is amended to read: 
  2.26     Subd. 6a.  [SALARY.] "Salary" means the regular 
  2.27  compensation payable under law to legislators and paid to the 
  2.28  person for service as a legislator.  The term includes the 
  2.29  monthly compensation paid to the legislator, and the per diem 
  2.30  payments paid during a regular or special session to the 
  2.31  legislator before the effective date of sections 1 to 3.  The 
  2.32  term does not include per diem payments paid other than during 
  2.33  the regular or special session, additional compensation 
  2.34  attributable to a leadership position under section 3.099, 
  2.35  subdivision 3, living expense payments under section 3.101, and 
  2.36  special session living expense payments under section 3.103. 
  3.1      Sec. 4.  [COMPENSATION COUNCIL.] 
  3.2      In making recommendations in 1995 on the salary of 
  3.3   legislators, the compensation council shall take into account 
  3.4   the effect of sections 1 to 3 on the compensation of legislators.
  3.5      Sec. 5.  [EFFECTIVE DATE.] 
  3.6      Sections 1 to 3 are effective on January 1, 1997.
