  1.1                          A bill for an act 
  1.2             relating to education; creating an exception to levy 
  1.3             authority for new construction based on emergency 
  1.4             closing of an operating school building; amending 
  1.5             Minnesota Statutes 2002, section 123B.59, subdivision 
  1.6             5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 123B.59, 
  1.9   subdivision 5, is amended to read: 
  1.10     Subd. 5.  [LEVY AUTHORIZED.] A district, after local board 
  1.11  approval, may levy for costs related to an approved facility 
  1.12  plan as follows:  
  1.13     (a) if the district has indicated to the commissioner that 
  1.14  bonds will be issued, the district may levy for the principal 
  1.15  and interest payments on outstanding bonds issued according to 
  1.16  subdivision 3 after reduction for any alternative facilities aid 
  1.17  receivable under subdivision 6; or 
  1.18     (b) if the district has indicated to the commissioner that 
  1.19  the plan will be funded through levy, the district may levy 
  1.20  according to the schedule approved in the plan after reduction 
  1.21  for any alternative facilities aid receivable under subdivision 
  1.22  6.; or 
  1.23     (c) if the district has an approved plan and has been 
  1.24  forced to vacate and permanently close a school building due to 
  1.25  unsafe infestation of microbe growth that forces relocation of 
  1.26  all school operations and the cost of renovation for this 
  2.1   condition exceeds the guidelines established by this section, 
  2.2   the school district may apply to the department of children, 
  2.3   families, and learning for a project-specific exception to allow 
  2.4   use of levy authority for new construction due to cost 
  2.5   efficiencies and expediency because of the emergency closing of 
  2.6   an operating school building.  No district shall be eligible for 
  2.7   alternative facilities aid under this provision.
