A bill for an act
relating to health care; modifying the Alec Smith Insulin Affordability Act;
appropriating money; amending Laws 2020, chapter 73, section 7.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2020, chapter 73, section 7, is amended to read:


Sec. 7. SEVERABILITY.

and clauses of this act are declared to be severable.

Sec. 2. new text begin CONTINGENT ENFORCEMENT OF MINNESOTA STATUTES, SECTION
151.74; PAYMENTS FOR URGENT-NEED INSULIN.

new text begin (a) If Minnesota Statutes, section 151.74, is temporarily or permanently restrained or
enjoined by judicial order, Minnesota Statutes, section 151.74, subdivision 3, shall be
enforced as provided in paragraph (b). If the judicial order is stayed or dissolved; or otherwise
ceases to have effect, Minnesota Statutes, section 151.74, subdivision 3, shall have the full
force and effect of law as enacted.

new text begin (b) A manufacturer may submit a request to the commissioner of administration for
reimbursement of payments paid to pharmacies under Minnesota Statutes, section 151.74,
subdivision 3, paragraph (d). The commissioner of administration shall reimburse each
manufacturer for requests submitted by the manufacturer and received by the commissioner.

new text begin This section is effective the day following final
enactment and expires June 30, 2021. Paragraph (b) is effective only if the condition in
paragraph (a) occur.

Sec. 3. new text begin APPROPRIATION.

new text begin $....... in fiscal year 2021 is appropriated from the health care access fund to the
commissioner of administration for payments to manufacturers in accordance with section
2 and is effective the day following final enactment. This is a onetime appropriation.

is authorized to make reimbursements as provided in section 2, paragraph (b).
