  1.1                          A bill for an act 
  1.2             relating to unemployment insurance; providing for a 
  1.3             benefit extension. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [STATE EXTENDED BENEFITS.] 
  1.6      Subdivision 1.  [FEDERAL PROGRAM TAKEOVER.] (a) An 
  1.7   applicant who received benefits for the week of December 28, 
  1.8   2002, under the federal Temporary Extended Unemployment 
  1.9   Compensation Act of 2002 and who did not receive the maximum 
  1.10  benefits to which the applicant was eligible under the federal 
  1.11  act solely due to the expiration of the federal act is eligible 
  1.12  to receive the remainder of those benefits from the state. 
  1.13     (b) The state benefits shall be paid on the same terms and 
  1.14  conditions as applied to benefits under the federal act.  
  1.15     Subd. 2.  [CONTINUATION OF STATE PROGRAM.] An applicant who 
  1.16  received benefits for the week of December 28, 2002, under Laws 
  1.17  2002, chapter 380, article 1, section 7, and who did not receive 
  1.18  the maximum benefit to which the applicant was otherwise 
  1.19  eligible under that section solely due to the expiration of that 
  1.20  section is eligible to receive the remainder of those benefits.  
  1.21  Benefits shall be paid on the same terms and conditions as 
  1.22  benefits were paid under the expired Laws 2002, chapter 380, 
  1.23  article 1, section 7.  
  1.24     Subd. 3.  [PAID FROM FUND.] Benefits paid under this 
  2.1   section are payable from the Minnesota unemployment insurance 
  2.2   program trust fund.  
  2.3      Subd. 4.  [CHARGING OF BENEFITS.] Benefits paid under this 
  2.4   section shall not be used to compute the future unemployment tax 
  2.5   rate of a taxpaying employer or charged to the reimbursing 
  2.6   account of a government or nonprofit employer.  
  2.7      Subd. 5.  [EXPIRATION.] This section expires June 30, 
  2.8   2003.  No payments under this section shall be made for any week 
  2.9   after the expiration date.  
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     Section 1 is effective retroactively from December 28, 2002.
