A bill for an act
relating to crimes; providing that careless driving resulting in death is a gross
misdemeanor; amending Minnesota Statutes 2010, section 169.13, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 169.13, is amended by adding a
subdivision to read:


Subd. 2a.

Careless driving resulting in death.

(a) A person who drives, operates,
or halts a vehicle, anywhere in this state, carelessly or heedlessly in disregard of the rights
of others or in a manner that endangers or is likely to endanger any property or any person,
including any driver or passenger of a vehicle or other person, that results in the death of a
person, is guilty of a gross misdemeanor.

(b) Nothing in this subdivision or section 609.035 limits the power of the state to
punish a person for conduct that constitutes a crime under any other law of this state.

EFFECTIVE DATE.

This section is effective August 1, 2012, and applies to
violations committed on or after that date.
