  1.1                          A bill for an act
  1.2             relating to controlled substances; classifying 
  1.3             methcathinone as a Schedule II controlled substance; 
  1.4             amending Minnesota Statutes 1996, section 152.02, 
  1.5             subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 152.02, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  The following items are listed in Schedule II:  
  1.10     (1) Unless specifically excepted or unless listed in 
  1.11  another schedule, any of the following substances whether 
  1.12  produced directly or indirectly by extraction from substances of 
  1.13  vegetable origin or independently by means of chemical 
  1.14  synthesis, or by a combination of extraction and chemical 
  1.15  synthesis:  
  1.16     (a) Opium and opiate, and any salt, compound, derivative, 
  1.17  or preparation of opium or opiate, including the following:  raw 
  1.18  opium, opium extracts, opium fluid extracts, powdered opium, 
  1.19  granulated opium, tincture of opium, apomorphine, codeine, 
  1.20  ethylmorphine, hydrocodone, hydromorphone, metopon, morphine, 
  1.21  oxycodone, oxymorphone, thebaine.  
  1.22     (b) Any salt, compound, derivative, or preparation thereof 
  1.23  which is chemically equivalent or identical with any of the 
  1.24  substances referred to in clause (a), except that these 
  1.25  substances shall not include the isoquinoline alkaloids of opium.
  2.1      (c) Opium poppy and poppy straw.  
  2.2      (d) Coca leaves and any salt, compound, derivative, or 
  2.3   preparation of coca leaves, including cocaine and ecgonine, the 
  2.4   salts and isomers of cocaine and ecgonine, and the salts of 
  2.5   their isomers. 
  2.6      (e) Any salt, compound, derivative, or preparation thereof 
  2.7   which is chemically equivalent or identical with any of the 
  2.8   substances referred to in clause (d), except that the substances 
  2.9   shall not include decocainized coca leaves or extraction of coca 
  2.10  leaves, which extractions do not contain cocaine or ecgonine.  
  2.11     (2) Any of the following opiates, including their isomers,
  2.12  esters, ethers, salts, and salts of isomers, esters and ethers, 
  2.13  unless specifically excepted, or unless listed in another 
  2.14  schedule, whenever the existence of such isomers, esters, ethers 
  2.15  and salts is possible within the specific chemical designation:  
  2.16  Alfentanil; Alphaprodine; Anileridine; Bezitramide; 
  2.17  Dihydrocodeine; Dihydromorphinone; Diphenoxylate; Fentanyl; 
  2.18  Isomethadone; Levomethorphan; Levorphanol; Metazocine; 
  2.19  Methadone; Methadone - Intermediate, 4-cyano-2-dimethylamino-4, 
  2.20  4-diphenylbutane; Moramide - Intermediate, 
  2.21  2-methyl-3-morpholino-1, 1-diphenyl-propane-carboxylic acid; 
  2.22  Pethidine; Pethidine - Intermediate - A, 
  2.23  4-cyano-1-methyl-4-phenylpiperidine; Pethidine - Intermediate - 
  2.24  B, ethyl-4-phenylpiperidine-4-carboxylate; Pethidine - 
  2.25  Intermediate - C, 1-methyl-4-phenylpiperidine-4-carboxylic acid; 
  2.26  Phenazocine; Piminodine; Racemethorphan; Racemorphan. 
  2.27     (3) Unless specifically excepted or unless listed in 
  2.28  another schedule, any material, compound, mixture, or 
  2.29  preparation which contains any quantity of the following 
  2.30  substances having a stimulant effect on the central nervous 
  2.31  system:  
  2.32     (a) Amphetamine, its salts, optical isomers, and salts of 
  2.33  its optical isomers; 
  2.34     (b) Methamphetamine, its salts, isomers, and salts of its 
  2.35  isomers; 
  2.36     (c) Phenmetrazine and its salts; 
  3.1      (d) Methylphenidate; 
  3.2      (e) Methcathinone, cathinone, its salts, isomers, and salts 
  3.3   of its isomers. 
  3.4      (4) Unless specifically excepted or unless listed in 
  3.5   another schedule, any material, compound, mixture, or 
  3.6   preparation which contains any quantity of the following 
  3.7   substances having a depressant effect on the central nervous 
  3.8   system, including its salts, isomers, and salts of isomers 
  3.9   whenever the existence of such salts, isomers, and salts of 
  3.10  isomers is possible within the specific chemical designation:  
  3.11     (a) Methaqualone 
  3.12     (b) Amobarbital 
  3.13     (c) Secobarbital 
  3.14     (d) Pentobarbital 
  3.15     (e) Phencyclidine 
  3.16     (f) Phencyclidine immediate precursors:  
  3.17     (i) 1-phenylcyclohexylamine 
  3.18     (ii) 1-piperidinocyclohexanecarbonitrile. 
  3.19     Sec. 2.  [EFFECTIVE DATE.] 
  3.20     Section 1 is effective August 1, 1997, and applies to 
  3.21  crimes committed on or after that date.
