  1.1                          A bill for an act 
  1.2             relating to crime prevention; striking the 
  1.3             classification of Carisoprodol as a schedule IV 
  1.4             controlled substance; amending Minnesota Statutes 
  1.5             2000, section 152.02, subdivision 5; Laws 1997, 
  1.6             chapter 239, article 4, section 15, as amended. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 152.02, 
  1.9   subdivision 5, is amended to read: 
  1.10     Subd. 5.  [SCHEDULE IV.] (a) The following items are listed 
  1.11  in Schedule IV: Anabolic substances; Barbital; 
  1.12  Butorphanol; Carisoprodol; Chloral betaine; Chloral hydrate; 
  1.13  Chlordiazepoxide; Clonazepam; Clorazepate; Diazepam; 
  1.14  Diethylpropion; Ethchlorvynol; Ethinamate; Fenfluramine; 
  1.15  Flurazepam; Mebutamate; Methohexital; Meprobamate except when in 
  1.16  combination with the following drugs in the following or lower 
  1.17  concentrations:  conjugated estrogens, 0.4 mg; tridihexethyl 
  1.18  chloride, 25mg; pentaerythritol tetranitrate, 20 mg; 
  1.19  Methylphenobarbital; Oxazepam; Paraldehyde; Pemoline; 
  1.20  Petrichloral; Phenobarbital; and Phentermine.  
  1.21     (b) For purposes of this subdivision, "anabolic substances" 
  1.22  means the naturally occurring androgens or derivatives of 
  1.23  androstane (androsterone and testosterone); testosterone and its 
  1.24  esters, including, but not limited to, testosterone propionate, 
  1.25  and its derivatives, including, but not limited to, 
  1.26  methyltestosterone and growth hormones, except that anabolic 
  2.1   substances are not included if they are:  (1) expressly intended 
  2.2   for administration through implants to cattle or other nonhuman 
  2.3   species; and (2) approved by the United States Food and Drug 
  2.4   Administration for that use. 
  2.5      Sec. 2.  Laws 1997, chapter 239, article 4, section 15, as 
  2.6   amended by Laws 1998, chapter 367, article 4, section 7, Laws 
  2.7   1999, chapter 9, section 1, and Laws 2000, chapter 262, section 
  2.8   1, is amended to read: 
  2.9      Sec. 15.  [EFFECTIVE DATE.] 
  2.10     The provision of section 4 relating to the listing of 
  2.11  Butorphanol in schedule IV is effective August 1, 1998, and 
  2.12  applies to acts committed on or after that date.  The provision 
  2.13  of section 4 relating to the listing of Carisoprodol in schedule 
  2.14  IV is effective August 1, 2001, and applies to acts committed on 
  2.15  or after that date.  Sections 1 to 3 and 5 to 13 are effective 
  2.16  August 1, 1997, and apply to acts committed on or after that 
  2.17  date.  Section 14 is effective the day following final enactment.
  2.18     Sec. 3.  [EFFECTIVE DATE.] 
  2.19     Sections 1 and 2 are effective August 1, 2001.
