  1.1                          A bill for an act 
  1.2             relating to human services; requiring ineligibility 
  1.3             for MinnesotaCare enrollees who exceed income 
  1.4             guidelines; amending Minnesota Statutes 1996, section 
  1.5             256.9357, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 256.9357, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [GENERAL REQUIREMENTS.] Families and 
  1.10  individuals who enroll on or after October 1, 1992, are eligible 
  1.11  for subsidized premium payments based on a sliding scale under 
  1.12  section 256.9358 only if the family or individual meets the 
  1.13  requirements in subdivisions 2 and 3.  Children already enrolled 
  1.14  in the children's health plan as of September 30, 1992, eligible 
  1.15  under section 256.9354, subdivision 1, paragraph (a), children 
  1.16  who enroll in the MinnesotaCare program after September 30, 
  1.17  1992, pursuant to Laws 1992, chapter 549, article 4, section 17, 
  1.18  and children who enroll under section 256.9354, subdivision 4a, 
  1.19  are eligible for subsidized premium payments without meeting 
  1.20  these requirements, as long as they maintain continuous coverage 
  1.21  in the MinnesotaCare plan or medical assistance.  
  1.22     Families and individuals who initially enrolled in 
  1.23  MinnesotaCare under section 256.9354 or 256.9366, and whose 
  1.24  income increases above the limits established in section 
  1.25  sections 256.9358 and 256.9366, may continue enrollment and pay 
  2.1   the full cost of coverage are no longer eligible for the program 
  2.2   and shall be disenrolled by the commissioner.  MinnesotaCare 
  2.3   coverage terminates the last day of the calendar month following 
  2.4   the month in which the department determines that the income of 
  2.5   a family or individual, determined over a four-month period as 
  2.6   required by section 256.9358, exceeds program income limits.
