A bill for an act
 relating to education finance; authorizing building lease aid for private contract
alternative schools; appropriating money; amending Minnesota Statutes 2022,
section 124D.69, subdivision 2, by adding a subdivision; Laws 2023, chapter 55,
article 2, section 64, subdivision 6.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 124D.69, is amended by adding a subdivision
to read:

new text begin Building lease and facilities aid. new text end

new text begin (a) An alternative program under contract
receiving aid under subdivision 1 is eligible for building lease and facilities aid.

new text begin (b) For an alternative program that leases facility space, the building lease and facilities
aid equals the amount calculated for charter schools under section 124E.22. For an alternative
program that is in an owner-occupied building, the alternative program must submit to the
commissioner the imputed amount of the annual facility costs for the instructional space
and other space used primarily for serving students in the alternative program's school.

new text begin (c) The commissioner must annually approve the lease and imputed facilities expenses,
and may request any information necessary to determine the amount of the payments.

Sec. 2.

Minnesota Statutes 2022, section 124D.69, subdivision 2, is amended to read:


Subd. 2.

Reserve account.

During the term of the contract to provide educational services

the account assigned to the alternative program site and is reserved for that site.

Laws 2023, chapter 55, article 2, section 64, subdivision 6, is amended to read:
