A bill for an act
relating to education; authorizing school districts to renew expiring referendums
for one year by action of school board.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Notwithstanding the election requirements of Minnesota Statutes, section 126C.17,
subdivision 9, a school board may renew a referendum for one year by board action if:

(1) the district's referendum revenue expires in fiscal year 2021 and the district has not
renewed the revenue for fiscal year 2022 and later;

(2) the per-pupil amount of the referendum is the same as the amount expiring, or for
an expiring referendum that was adjusted annually by the rate of inflation, the same as the
per-pupil amount of the expiring referendum, adjusted annually for inflation in the same
manner as if the expiring referendum had continued; and

(3) the school board has adopted a written resolution authorizing the renewal after
informing school district residents and providing a way to receive written comments.

(b) A resolution under this section must be adopted by the school board by August 15,
2020, and becomes effective 60 days after its adoption.

(c) A district renewing an expiring referendum under this section must submit a copy
of the adopted resolution to the commissioner of education and to the county auditor no
later than September 15 of the calendar year in which the levy is certified.

(d) A referendum under this section expires in the last fiscal year in which the referendum
generates revenue for the school district.

This section is effective the day following final enactment for
revenue for fiscal year 2022 only.
