  1.1                          A bill for an act 
  1.2             relating to cities; specifying and clarifying the 
  1.3             authority of cities to exercise certain town powers 
  1.4             and to impose service charges for emergency services; 
  1.5             amending Minnesota Statutes 2002, section 415.01. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 415.01, is 
  1.8   amended to read: 
  1.9      415.01 [TOWN LAWS, APPLICATION; EXERCISE OF POWERS BY 
  1.10  CITY.] 
  1.11     Nothing contained Subdivision 1.  [GENERAL.] A town must 
  1.12  not exercise the powers conferred in chapters 365 to 368 shall 
  1.13  apply to within the territory embraced within the limits of any 
  1.14  city, but each a city shall have has and may exercise within 
  1.15  its limits all any of the powers conferred by these chapters 
  1.16  upon towns.  
  1.17     Subd. 2.  [CHARGES FOR EMERGENCY SERVICES.] A city may 
  1.18  exercise the power under sections 366.011 and 366.012 relating 
  1.19  to charges for emergency services only if the city adopts an 
  1.20  ordinance authorizing the manner and amount of charging for 
  1.21  those services.
