A bill for an act
relating to health; waiving the four-month waiting period for unemployed
persons for MinnesotaCare; appropriating money; amending Minnesota Statutes
2008, section 256L.07, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256L.07, is amended by adding a
subdivision to read:

new text begin Temporary eligibility for unemployed persons. new text end

new text begin (a) Any person
receiving unemployment compensation under chapter 268 and who continues to meet the
definition of unemployed defined in section 268.035, subdivision 26, is exempt from the
four-month waiting period described in subdivision 3. The commissioner of employment
and economic development shall provide written notice of this eligibility change to all
persons receiving unemployment compensation. Persons eligible for services under
this subdivision shall be provided health benefits on a fee-for-service basis with state
only funds, and are exempt from managed care enrollment under section 256L.12. The
commissioner of human services shall seek approval for federal matching funds within 30
days of the effective date of this subdivision.

new text begin (b) For individuals eligible under paragraph (a) the following provisions are waived:

new text begin (i) the asset requirement under 256L.04;
new text end

new text begin (ii) the income limit for spouses under 256L.04, subdivision 10a; and
new text end

new text begin (iii) the application requirements under 256L.05.

new text begin (c) Individuals requesting health benefits under this subdivision must provide a
sworn statement to the commissioner of employment and economic development that the
individual's only income is the amount received as unemployment compensation.

new text begin (d) After six months of receiving health benefits under this subdivision, individuals
must reapply for MinnesotaCare and all requirements under chapter 256L apply.
