  1.1                          A bill for an act 
  1.2             relating to human services; changing child care 
  1.3             licensing provisions; amending Minnesota Statutes 
  1.4             2002, section 245A.14, subdivision 8. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 245A.14, 
  1.7   subdivision 8, is amended to read: 
  1.8      Subd. 8.  [EXPERIENCED AIDES; CHILD CARE CENTERS.] (a) An 
  1.9   individual employed as an aide at a child care center may work 
  1.10  with children without being directly supervised for up to an 
  1.11  amount of time that does not exceed 25 percent of the 
  1.12  individual's child care center's daily work shift hours if: 
  1.13     (1) a teacher is in the building facility; 
  1.14     (2) the individual has received first aid training within 
  1.15  the last three years and CPR training within the last two years; 
  1.16  and 
  1.17     (3) the individual is at least 20 years old; and 
  1.18     (4) the individual has at least 4,160 hours of child care 
  1.19  experience as defined in section 245A.02, subdivision 6b a staff 
  1.20  member in a licensed child care center or as the license holder 
  1.21  of a family day care home, 120 days of which must be in the 
  1.22  employment of the current company. 
  1.23     (b) The use of an experienced aide working without direct 
  1.24  supervision under paragraph (a) is limited to 25 percent of each 
  1.25  classroom's daily hours of operation. 
  2.1      (c) A child care center that uses experienced aides under 
  2.2   this subdivision must notify the commissioner once per year.  
  2.3   The notification must indicate the approximate number of hours 
  2.4   per classroom per month that this subdivision is used.  Upon 
  2.5   enrollment and once each year, child care centers must report to 
  2.6   notify parents or guardians if they use experienced aides under 
  2.7   this subdivision. 
  2.8      (d) This subdivision sunsets June 30, 2003. by posting the 
  2.9   notification in each classroom that uses experienced aides, 
  2.10  identifying which staff member is the experienced aide.  Records 
  2.11  of experienced aide usage must be kept on-site and given to the 
  2.12  commissioner upon request.  
  2.13     (c) A child care center may not use the experienced aide 
  2.14  provision for one year following two determined experienced aide 
  2.15  violations within a one-year period.  
  2.16     (d) A child care center may use one experienced aide per 
  2.17  every four full-time child care classroom staff.
