A bill for an act
relating to higher education; requiring notation on transcripts of certain students
disciplined or investigated for sexual assault; proposing coding for new law in
Minnesota Statutes, chapter 135A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin This section applies to the following postsecondary
institutions:

new text begin (1) institutions governed by the Board of Trustees of the Minnesota State Colleges and
Universities; and
new text end

new text begin (2) private postsecondary institutions that offer in-person courses on a campus located
in Minnesota and which are eligible institutions as defined in section 136A.103.

new text begin Institutions governed by the Board of Regents of the University of Minnesota are requested
to comply with this section.

new text begin Academic transcripts; notation for offense involving sexual assault. new text end

new text begin (a) The
registrar of a postsecondary institution, or the other employee, office, or department of the
institution that is responsible for maintaining student academic records, must include a
prominent notation on the academic transcript of each student who has been suspended for,
has been permanently dismissed or expelled for, or withdraws from the institution while
under investigation for an offense involving sexual assault under the institution's code, rules,
or set of standards governing student conduct pursuant to section 135A.15. The notation
must state that the student was suspended for or was permanently dismissed or expelled for
an offense involving sexual assault under the institution's code, rules, or set of standards.
The notation must be substantially in the following form: "[Suspended, Dismissed, Expelled,
or Withdrew while under investigation] for a violation of [insert name of institution's code,
rules, or set of standards]."

new text begin (b) An institution must:

new text begin (1) notify the student that the suspension, permanent dismissal, expulsion, or withdrawal
will be documented on the student's academic transcript; and
new text end

new text begin (2) adopt and publish a procedure for removing the notation from the academic transcript
of a student who is subsequently found not to have committed an offense involving sexual
assault under the institution's code, rules, or set of standards governing student conduct.

new text begin (c) The institution must remove from a student's academic transcript the notation placed
on a transcript pursuant to paragraph (a):

new text begin (1) if the notation was due to the student's suspension and the student completed the
term and any conditions of the suspension and has been determined by the institution to be
in good standing according to the institution's code, rules, or set of standards governing the
determination; or

new text begin (2) if ten years have passed since the transcript notation.
