1.1 A bill for an act 1.2 relating to game and fish; imposing restrictions for 1.3 conibear-type traps; proposing coding for new law in 1.4 Minnesota Statutes, chapter 97B. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [97B.932] [CONIBEAR TRAPPING RESTRICTIONS.] 1.7 Subdivision 1. [DEFINITION.] For the purposes of this 1.8 section, "enclosure" means any device that creates a barrier to 1.9 the trap allowing entry only through designated openings. 1.10 Subd. 2. [CONIBEAR RESTRICTIONS.] (a) No person may set, 1.11 place, or operate a conibear-type trap as: 1.12 (1) a water set, unless one-half of the set trap is located 1.13 underwater at all times; 1.14 (2) an elevated set, unless the trap is placed at least 1.15 five feet above the surface; 1.16 (3) a baited or scented set in or on the ground, unless the 1.17 trap trigger is within an enclosure that provides openings no 1.18 greater than 50 square inches for a seven-inch recess, or an 1.19 eight-inch height by ten-inch width opening with a ten-inch 1.20 minimum recess from the enclosure openings; 1.21 (4) an unbaited or unscented trail set, unless the trap is 1.22 within an enclosure that provides openings no greater than ten 1.23 inches in height and ten inches in width and is recessed a 1.24 minimum of 15 inches from the enclosure openings; or 1.25 (5) a bottom entry enclosure set, unless the entire opening 2.1 of the enclosure is no more than seven inches above the surface. 2.2 (b) The measurement to the surface must be the distance to 2.3 the first surface beneath the trap or opening, where the surface 2.4 is ground, ice, crusted or packed snow, or any other hard 2.5 material.
