A bill for an act
relating to health; requiring those performing mercury level analysis in humans
to report the results and epidemiological information to the commissioner of
health; proposing coding for new law in Minnesota Statutes, chapter 144.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Every hospital,
medical clinic, medical laboratory, other facility, or individual performing analysis of
mercury levels in humans shall report the results of the analysis of each specimen
analyzed, the method by which the specimen was tested, and the epidemiological
information required in subdivision 2 to the commissioner of health, within ten working
days by telephone, fax, or electronic transmission.

The epidemiologic information required to
be reported under this section must specify:

(1) the results of the analysis;
new text end
new text begin
(2) the date the specimen analyzed was collected;
new text end
new text begin
(3) the date the specimen was analyzed;
new text end
new text begin
(4) the method of analysis used;
new text end
new text begin
(5) the full name, address, telephone number, date of birth, gender, and race of
the person being tested;

(6) the full name, address, and telephone number of the laboratory performing the
analysis; and

(7) the full name, address, and telephone number of the physician or facility
requesting the analysis.

The commissioner of health shall coordinate
with hospitals, medical clinics, medical laboratories, and other facilities performing
mercury analysis to develop a universal reporting form and mechanism.

Notwithstanding any law to the contrary, including
section 13.05, subdivision 9, data collected by the commissioner of health under this
section, including analytic results and epidemiologic information, must be private and
may only be used by the commissioner of health.

This section is effective July 1, 2006.
