1.1 A bill for an act 1.2 relating to alcoholic beverages; allowing municipal 1.3 liquor stores to conduct wine tastings; amending 1.4 Minnesota Statutes 1998, section 340A.418, subdivision 1.5 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 340A.418, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [TASTINGS AUTHORIZED.] (a) A charitable, 1.10 religious, or other nonprofit organization or municipal liquor 1.11 store may conduct a wine tasting. 1.12 (b) In the case of a wine tasting conducted by an 1.13 organization, the event may be held on premises the organization 1.14 owns or leases or has use donated to it, or on the licensed 1.15 premises of a holder of an on-sale intoxicating liquor license 1.16 that is not a temporary license, if the organization holds a 1.17 temporary on-sale intoxicating liquor license under section 1.18 340A.404, subdivision 10, and complies with this section. In 1.19 the case of a wine tasting conducted by a municipal liquor 1.20 store, the event may be held on the licensed premises of a 1.21 holder of an on-sale intoxicating liquor license that is not a 1.22 temporary license. 1.23 (c) An organization holding a temporary license may be 1.24 assisted in conducting the wine tasting by another nonprofit 1.25 organization. 2.1
(b)(d) An organization that conducts a wine tasting under 2.2 this section may use the net proceeds from the wine tasting only 2.3 for: 2.4 (1) the organization's primary nonprofit purpose; or 2.5 (2) donation to another nonprofit organization assisting in 2.6 the wine tasting, if the other nonprofit organization uses the 2.7 donation only for that organization's primary nonprofit purpose. 2.8 (c)(e) No wine at a wine tasting under this section may be 2.9 sold, or orders taken, for off-premises consumption. 2.10 (d)(f) Notwithstanding any other law, an organization or 2.11 municipal liquor store may purchase or otherwise obtain wine for 2.12 a wine tasting conducted under this section from a wholesaler 2.13 licensed to sell wine, and the wholesaler may sell or give wine 2.14 to an organization or municipal liquor store for a wine tasting 2.15 conducted under this section and may provide personnel to assist 2.16 in the wine tasting. A wholesaler who sells or gives wine to an 2.17 organization or municipal liquor store for a wine tasting under 2.18 this section must deliver the wine directly to the location 2.19 where the wine tasting is conducted. 2.20 (e)(g) This section does not prohibit or restrict a wine 2.21 tasting that is: 2.22 (1) located on on-sale premises where no charitable 2.23 organization is participating; or 2.24 (2) located on on-sale premises where the proceeds are for 2.25 a designated charity but where the tasting is primarily for 2.26 educational purposes. 2.27 Sec. 2. [EFFECTIVE DATE.] 2.28 Section 1 is effective the day following final enactment.
