  1.1                          A bill for an act 
  1.2             relating to appropriations; providing for unexpended 
  1.3             funds to be used for maintenance; amending Minnesota 
  1.4             Statutes 1998, section 16A.28, by adding a subdivision.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 16A.28, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 9.  [CARRYOVER FOR REPAIR AND MAINTENANCE.] 
  1.9   Notwithstanding subdivision 3, any portion of an appropriation 
  1.10  from the general fund to the board of trustees of the Minnesota 
  1.11  state colleges and universities that does not carry over at the 
  1.12  end of the fiscal year for which it was made, or at the close of 
  1.13  a biennium, is appropriated to the board for the next biennium 
  1.14  for repair and maintenance of facilities owned by the board and 
  1.15  occupied by the college or university for which it was 
  1.16  originally allocated.  By January 1, 2003, the board of trustees 
  1.17  shall report to the chairs of the house capital investment 
  1.18  committee, the house ways and means committee, the senate 
  1.19  finance committee, and the committees in the house and senate 
  1.20  that are responsible for oversight of the board's budget on the 
  1.21  use of this subdivision. 
  1.22     This subdivision is repealed effective June 30, 2010.
