  1.1                          A bill for an act 
  1.2             relating to appropriations; providing for unexpended 
  1.3             funds to be used for maintenance; amending Minnesota 
  1.4             Statutes 1998, section 16A.28, by adding a subdivision.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 16A.28, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 9.  [CARRYOVER FOR REPAIR AND MAINTENANCE.] 
  1.9   Notwithstanding subdivision 3, any portion of an appropriation 
  1.10  from the general fund that does not carry over at the end of the 
  1.11  fiscal year for which it was made, or at the close of a 
  1.12  biennium, is appropriated to the commissioner of administration 
  1.13  for the next biennium for repair and maintenance of the 
  1.14  state-owned facility or facilities occupied by the agency to 
  1.15  which the original appropriation was made.  The commissioner of 
  1.16  administration shall consult with the agency as to the repairs 
  1.17  and maintenance to be done.  If the agency does not occupy a 
  1.18  state-owned facility, the appropriation lapses as provided in 
  1.19  subdivision 3.  By January 1, 2003, the commissioner shall 
  1.20  report to the chairs of the house capital investment committee, 
  1.21  the house ways and means committee, the senate finance 
  1.22  committee, and the committees in the house and senate that are 
  1.23  responsible for oversight of each agency's budget on the use of 
  1.24  this subdivision.  
  1.25     This subdivision is repealed effective June 30, 2010.
