A bill for an act
relating to health; modifying staffing for transportation of medical cannabis Next ;
amending Minnesota Statutes 2020, section 152.29, subdivision 3a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 152.29, subdivision 3a, is amended to read:


Subd. 3a.

Transportation of medical Previous cannabis Next ; new text begin transport new text end staffing.

(a) A medical
Previous cannabis Next manufacturer may staff a transport motor vehicle with only one employee if the
medical Previous cannabis Next manufacturer is transporting medical Previous cannabis Next to either a certified
laboratory for the purpose of testing or a facility for the purpose of disposal. If the medical
Previous cannabis Next manufacturer is transporting medical Previous cannabis Next for any other purpose or destination,
the transport motor vehicle must be staffed with a minimum of two employees as required
by rules adopted by the commissioner.

(b) Notwithstanding paragraph (a), a medical Previous cannabis Next manufacturer that is only
transporting hemp for any purpose may staff the transport motor vehicle with only one
employee.

new text begin (c) A medical Previous cannabis Next manufacturer may contract with a third party for armored car
services for deliveries of medical Previous cannabis Next from its production facility to distribution
facilities. A medical Previous cannabis Next manufacturer that contracts for armored car services remains
responsible for transportation manifest and inventory tracking requirements in rules adopted
by the commissioner.

new text begin (d) Department of Health staff may transport medical Previous cannabis Next for the purposes of
delivering medical Previous cannabis Next and other samples to a laboratory for testing under rules adopted
by the commissioner and in cases of special investigations when the commissioner has
determined there is a potential threat to public health.

Health employees. The employees must carry with them their Department of Health
identification card and a transport manifest that meets the requirements of ........

new text begin (f) A Tribal medical Previous cannabis Next program operated by a federally recognized Indian Tribe
located within the state of Minnesota may transport samples of medical Previous cannabis Next to testing
laboratories in the state. Transport vehicles must be staffed by at least two employees of
the Tribal medical Previous cannabis Next program. Transporters must carry identification identifying
them as employees of the Tribal medical Previous cannabis Next program and a detailed transportation
manifest that includes the place and time of departure, the address of testing laboratory
destination, and a description and count of medical Previous cannabis being transported.
