A bill for an act
relating to airports; requiring the commissioner of transportation and local units
of government to adopt a model zoning ordinance to limit height of objects
around airports; proposing coding for new law in Minnesota Statutes, chapter
360.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) The commissioner shall adopt, by December 31, 2007, a model zoning ordinance
under chapter 14 to control the height of objects around airports. The model ordinance
adopted under this section must conform to and rely on the standards prescribed by the
United States Department of Transportation, Federal Aviation Administration, in the
Model Zoning Ordinance to Limit Height of Objects Around Airports, as amended. The
model ordinance must apply only to new development and not to development that has
occurred, or for which development permits have been issued, before the effective date of
the ordinance.

new text begin (b) By August 1, 2008, each municipality, county, or joint airport zoning board shall
adopt an airport zoning ordinance regulating height limitations that meets or exceeds the
minimum standards of the model ordinance and is approved by the commissioner. The
model ordinance applies in a jurisdiction where the local governmental unit does not
adopt an airport zoning height ordinance that is approved by the commissioner by August
1, 2008.
