1.1 A bill for an act 1.2 relating to crime prevention; adding criminal 1.3 penalties for fires caused by grossly negligent 1.4 persons that result in bodily harm to a person; making 1.5 technical changes to the negligent fire law; amending 1.6 Minnesota Statutes 2002, section 609.576, subdivision 1.7 1. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2002, section 609.576, 1.10 subdivision 1, is amended to read: 1.11 Subdivision 1. [NEGLIGENT FIRE RESULTING IN INJURY OR 1.12 PROPERTY DAMAGE.] Whoever is grossly negligent in causing a fire 1.13 to burn or get out of control thereby causing damage or injury 1.14 to another, and as a resultthereofof this: 1.15(a)(1) a human being is injured and great bodily harm 1.16 incurred, is guilty of a crime and may be sentenced to 1.17 imprisonmentoffor not more than five years or to payment of a 1.18 fine of not more than $10,000, or both; 1.19 (2) a human being is injured and bodily harm incurred, is 1.20 guilty of a crime and may be sentenced to imprisonment for not 1.21 more than one year or to payment of a fine of not more than 1.22 $3,000, or both; or 1.23(b)(3) property of another is injured, thereby, is guilty 1.24 of a crime and may be sentenced as follows: 1.25(1)(i) to imprisonment for not more than 90 days or to 1.26 payment of a fine of not more than$700$1,000, or both, if the 2.1 value of the property damage is under $300; 2.2(2)(ii) to imprisonment for not more than one year,or to 2.3 payment of a fine of not more than $3,000, or both, if the value 2.4 of the property damaged is at least $300 but is less than 2.5 $2,500; or 2.6(3)(iii) to imprisonment for not more than three years,or 2.7 to payment of a fine of not more than $5,000, or both, if the 2.8 value of the property damaged is $2,500 or more. 2.9 [EFFECTIVE DATE.] This section is effective August 1, 2003, 2.10 and applies to crimes committed on or after that date.
