A bill for an act
relating to education; requiring continuing contract teachers to make an election
under their collective bargaining agreement; proposing coding for new law in
Minnesota Statutes, chapter 122.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding other law to the contrary, a public employer and the exclusive
representative of the teachers in a school district, as part of the collective bargaining
agreement, must require a teacher under section 122A.40 or 122A.41 who successfully
completes a probationary period to make a onetime binding election in the district
whereby the teacher either:

(1) foregoes the teacher's continuing contract or tenure rights, becomes an at-will
employee of the district, and is eligible to automatically receive the compensation
increases that are stipulated in the collected bargaining agreement; or

(2) retains the teacher's continuing contract or tenure rights but must individually
negotiate compensation increases with the public employer that are separate from the
compensation increases stipulated in the collective bargaining agreement.

This section is effective the day following final enactment
and applies to all collective bargaining agreements entered into or modified after that date.
