A bill for an act
relating to capital investment; appropriating money for intersection and associated
improvements on 105th Avenue Northeast and 109th Avenue Northeast at marked
Trunk Highway 65 in Blaine; authorizing the sale and issuance of state bonds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) $51,000,000 is appropriated from the bond proceeds
account in the state transportation fund to the commissioner of transportation for one or
more grants to Anoka County, the city of Blaine, or both, for intersection improvements at
105th Avenue Northeast and marked Trunk Highway 65, and at Anoka County State-Aid
Highway 12, known as 109th Avenue Northeast, and marked Trunk Highway 65, and if
necessary for the construction of any associated: (1) frontage roads; (2) backage roads; (3)
connecting local roads; and (4) utility infrastructure improvements. This appropriation does
not require a nonstate contribution.

(b) $12,000,000 of the appropriation in paragraph (a) is for acquisition of rights-of-way
associated with the local road portions of the project.

(c) $39,000,000 of the appropriation in paragraph (a) is for construction of the
improvements associated with the local road portions of the project.

(d) Upon written notice to the commissioner of management and budget, any unspent
portion of the appropriation in paragraph (a) remaining after completion of the project phase
or project is available for any other phase of the project or other intersection improvement
projects on local roads that intersect marked Trunk Highway 65 in Spring Lake Park, Blaine,
or Ham Lake.

To provide the money appropriated in this section from the bond
proceeds account in the state transportation fund, the commissioner of management and
budget shall sell and issue bonds of the state in an amount up to $51,000,000 in the manner,
upon the terms, and with the effect prescribed by Minnesota Statutes, sections 16A.631 to
16A.675, and by the Minnesota Constitution, article XI, sections 4 to 7.
