A bill for an act
relating to natural resources; restricting the use of four by four trucks on public
lands; amending Minnesota Statutes 2004, section 84.803, subdivision 2;
proposing coding for new law in Minnesota Statutes, chapter 84.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 84.803, subdivision 2, is amended to read:


Subd. 2.

Purposes.

Subject to appropriation by the legislature, money in the
off-road vehicle account may only be spent for:

(1) administration, enforcement, and implementation of sections 84.773 to 84.805;

(2) acquisition, maintenance, and development of off-road vehicle trails and use
areas;

(3) grant-in-aid programs to counties and municipalities to construct and maintain
off-road vehicle trails and use areas;

(4) grants-in-aid to local safety programs; deleted text begin and

Sec. 2.

new text begin [84.8045] RESTRICTIONS ON FOUR BY FOUR TRUCKS.
new text end

new text begin (a) Notwithstanding any provision of sections 84.797 to 84.805 or other law to the
contrary, a four by four truck may not be operated off-road on public lands, except:

new text begin (1) on state forest roads, county forest roads, and other roads that are not operated by
a public road authority as defined in section 160.02, subdivision 25; or

new text begin (2) in designated off-road vehicle use areas.

new text begin (b) For purposes of this section, "four by four truck" means a four-wheeled motor
vehicle that was manufactured to operate primarily upon public roads and highways
and that is subsequently modified with special tires, suspension, or other equipment for
cross-country travel on natural terrain.
