A bill for an act
relating to air pollution; requiring mixed municipal solid waste incinerators to
reduce carbon dioxide emissions; amending Minnesota Statutes 2018, section
116.07, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 116.07, is amended by adding a subdivision
to read:

commissioner must, no later than January 1, 2021, reopen all air quality permits issued by
the agency to mixed municipal solid waste processing facilities that recover energy from
processing to produce electricity and must insert in each permit an emission limit that
requires the facility, no later than 2030, to reduce its carbon dioxide emissions per ton of
mixed municipal solid waste processed by at least 45 percent from the level emitted by the
facility in 2019. If no actual measure of carbon dioxide emissions per ton of mixed municipal
solid waste processed for 2019 is available for a facility, the commissioner must estimate
the amount based on the best information available.
