A bill for an act
relating to human services; establishing allowances for counties that overspend
certain waivered services allotments under certain circumstances; proposing
coding for new law in Minnesota Statutes, chapter 256B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Waivered services for persons with developmental disabilities. new text end

county that overspends its allowed amounts in a calendar year under the waivered services
program for persons with developmental disabilities shall not be required to pay back the
amount of overspending when the net amount spent by all counties for these waivered
services is within the limits of appropriations for these services by all counties.

new text begin Community alternatives for disabled individuals. new text end

new text begin (a) A county that
overspends its allowed amounts in a calendar year under the community alternatives for
disabled individuals waivered services program shall not be required to pay back the
amount of overspending when the net amount spent by all counties for these waivered
services is within the limits of appropriations for these services by all counties.

new text begin (b) A county that authorizes more than the allowed appropriations amount for these
waivered services but whose expenditures are equal to or less than the allowed amount
shall not be required to pay back the difference between the allowed amount and the
authorized amount.

new text begin Traumatic brain injury waivered services. new text end

new text begin (a) A county that overspends
its allowed amounts in a calendar year under the traumatic brain injury waivered
services program shall not be required to pay back the amount of overspending when
the net amount spent by all counties for these waivered services is within the limits of
appropriations for these services by all counties.

new text begin (b) A county that authorizes more than the allowed appropriations amount for these
waivered services but whose expenditures are equal to or less than the allowed amount
shall not be required to pay back the difference between the allowed amount and the
authorized amount.
